THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of item 3 (Social Security Number (SSN)) of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his SSN as 101-XX-XXXX instead of 107-XX-XXXX. 2. The applicant states that the SSN listed on his DD Form 214 is wrong. 3. The applicant provides a copy of his social security account number card. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. His military record contains a DD Form 398 (Statement of Personal History) that he completed during his induction processing. Item 13 (Employment) contains a block for the SSN wherein he entered his SSN as "101-XX-XXXX." 3. On 9 December 1965, the applicant was inducted into the Army of the United States. The DA Form 20 (Enlisted Qualification Record) prepared upon his entry on active duty lists his SSN as 101-XX-XXXX. 4. The applicant's DA Form 201 (Military Personnel Records Jacket) containing all of his military records lists his SSN as “101-XX-XXXX.” 5. On 2 December 1967, the applicant was honorably released from active duty and transferred to the U.S. Army Reserve Control Group. The DD Form 214 he was issued at the time lists his SSN as "107-XX-XXXX." 6. The applicant provides a copy of his social security card. It lists his SSN as “101-XX-XXXX." DISCUSSION: The applicant's DD Form 398 shows the applicant disclosed his SSN as 101-XX-XXXX upon induction into the Army of the United States. This SSN is consistent with the SSN listed in the majority of the documents in his service record and the SSN listed on the social security card he provided.
