I have reviewed the findings, conclusions, and Board member recommendations. I find there is sufficient evidence to grant relief. Therefore, under the authority of Title 10, United States Code, section 1552, I direct that all Department of the Army Records of the individual concerned be corrected by amending his DD Form 214 to show his social security number as it appears on his social security card. 4. Request necessary administrative action be taken to effect the correction of records as indicated no later than 9 April 2018. Further, request that the individual concerned and counsel, if any, as well as any Members of Congress who have shown interest be advised of the correction and that the Army Board for Correction of Military Records be furnished a copy of the correspondence. THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) and all other military and Department of Veterans Administration (VA) records to show his correct social security number (SSN). Additionally, he requests the service number listed on his records be corrected to show his SSN instead of the service number. 2. He states his correct SSN is x2x-xx-xxxx. 3. He provides his DD Form 214 and social security card. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The ABCMR does not have the authority to correct VA records; however, the applicant may contact the VA and request a records correction to reflect his proper SSN. The request to correct his VA records will not be discussed any further in this Record of Proceedings. 3. The applicant was inducted into the Army of the United States on 4 January 1971. His Record of Induction shows his SSN was recorded under his name as x2x-xx-xxxx. Block 2 (Service Number) shows the entry "x3x-xx-xxxx." 4. The majority of the documents in his record contain his service number of x3x-xx-xxxx, with the exception of his Pre-induction Standard Form (SF) 88 (Report of Medical History) that shows his SSN as x2x-xx-xxxx. 5. Item 3 (SSN) of his DD Form 214 shows his SSN as x3x-xx-xxxx. 6. His social security card shows his SSN as x2x-xx-xxxx. REFERENCES: 1. Army Regulation 635-5 (Separation Documents), in effect at the time, states the DD Form 214 is a summary of a Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active service at the time of release from active duty, retirement, or discharge. 2. SSNs replaced service numbers effective 1 July 1969 for Army personnel. DISCUSSION: 1. The evidence of record shows effective 1 July 1969, SSNs were used instead of service numbers. The applicant's Record of Induction, SF Form 88, and social security card confirm his SSN as x2x-xx-xxxx. Therefore, it appears an error occurred in transcribing his SSN as his service number. 2. Many of the documents in the applicant's record are no longer in use or no longer serve a purpose outside of providing a historical record of his service.
