Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 to show he attended the "Jungle Operations Training Course" at Fort Davis, Panama and to add the "Jungle Expert Badge." 2. The applicant states: a. Item 25 (Education and Training Completed) on his DD Form 214, dated 7 June 1971, should have included the "Jungle Operations Training Course" in Panama, at Fort Davis. b. He attended the "Jungle Operations Training Course" in Panama, in August 1969, just prior to his deployment to the Republic of Vietnam in September 1969. c. Travel to and from Panama was through Charleston, South Carolina Air Base. d. He has no idea why his records were and are incomplete, but they should be corrected. e. He should be authorized to wear the "Jungle Expert Badge." 3. The applicant provides no additional evidence. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. After having prior enlisted service, of prior enlisted service in the Regular Army, the applicant accepted an appointment as a Reserve commissioned officer on 10 March 1967, in the rank of second lieutenant (O-1). He was ordered to active duty effective the date of his appointment. 3. The applicant's DA Form 66 (Officer Qualification Record) contains the following information: * item 14 (Civilian Education and Military Schooling) fails to show that the applicant completed or attended a "Jungle Operations Training Course * item 18 (Record of Assignments) does not show an assignment or temporary duty assignment to Panama * item 21 (Awards and Decorations) does not list the "Jungle Expert Badge” 4. On 7 June 1971, the applicant was released from active duty at the expiration of his active duty commitment and he was transferred to the United States Army Reserve Control Group (Reinforcement). His DD Form 214 does not list the “Jungle Expert Badge” or show he completed a Jungle Operations Training Course. REFERENCES: 1. Army Regulation 635-5 (Separation Documents), then in effect, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214. The regulation stated that the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. It stated: a. In item 24 enter all awards, decorations, medals, badges, citations and campaign ribbons awarded or authorized for all periods of service. Do not enter State awards and decorations on DD Form 214. Enter all Federal awards and decorations for first award. b. In item 25 (Military Education) list formal in-service (full-time attendance) training courses successfully completed during the period of service covered by title, length in weeks, and month and year completed. This information is to assist the Soldier in job placement and counseling; therefore, training courses for combat skills will not be listed. 2. Army Regulation 600-8-22 does not list the “Jungle Expert Badge” as an authorized award. DISCUSSION: 1. A review of the applicable regulation fails to reveal a "Jungle Expert Badge" listed therein. As such, there are no provisions for adding this award to his DD Form 214. 2. The applicant has not submitted any evidence and a review of his official military personnel file does not show that he ever attended a "Jungle Operations Training Course." According to the applicable regulation, only formal in-service (full-time attendance) training courses successfully completed during the period of service covered by title, length in weeks, and month and year completed should be listed on his DD Form 214.
