Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his social security number (SSN) as "X43-XX-XXXX" instead of "X34-XX-XXXX." 2. The applicant states he believes his DD Form 214 was issued to him with a typographical error. 3. The applicant provides: * DD Form 214 * social security account number card * National Guard Bureau (NGB) Form 22 (Report of Separation and Record of Service) CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Army National Guard of the State of North Carolina (NCARNG) on 6 July 1964. Item 2 (Service Number) of his DD Form 4 (Enlistment Record – Armed Forces of the United States) contains a National Guard service number. 3. The applicant was ordered to active duty training on 10 September 1964. The Army honorably released him from active duty on 10 March 1965. His DD Form 214 shows in Item 2 (Service Number) his National Guard service number. Item 32 (Remarks) contains his SSN as "X34-XX-XXXX." This document bears his signature. 4. The applicant's official military personnel record contains very few documents. It does contain two special orders showing his National Guard service number. 5. The applicant provides his NGB Form 22. He was discharged from the NCARNG on 5 July 1970 upon the expiration of his term of service. Item 2 (Service Number) shows the SSN "X37-XX-XXXX." 6. The applicant provides a copy of his social security account number card which lists his SSN as "X43-XX-XXXX." REFERENCES: 1. Army Regulation 635-5 (Separation Documents), then in effect, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. This regulation established standardized policy for the preparation of the DD Form 214. The regulation in effect at the time of the applicant's separation stated the SN and SSN of the separating service member would be entered on the DD Form 214. 2. Army Regulation 15-185 (ABCMR) prescribes the policies and procedures for correction of military records by the Secretary of the Army, acting through the ABCMR. The regulation provides that the ABCMR begins its consideration of each case with the presumption of administrative regularity. The applicant has the burden of proving an error or injustice by a preponderance of the evidence. DISCUSSION: 1. The applicant was a member of the NCARNG enlisting in 1964. At the time, the National Guard issued a specific service number to each Soldier. He entered active duty for training and then upon completing training he was issued a DD Form 214 containing his service number and an SSN. 2. Upon completion of his National Guard enlistment, he was discharged on 5 July 1970. He was issued an NGB Form 22 containing a different SSN than shown on his 1964 DD Form 214. 3. His DD Form 214 and NGB Form 22 are the only documents in the available records showing an SSN. Throughout his service the NCARNG used his National Guard service number. 4. For historical purposes, the Army has an interest in maintaining the integrity of its records. The data and information contained in those records should reflect the conditions and circumstances that existed at the time of records creation. In the absence of a showing of material error or injustice, there is a reluctance to recommend changing those records. 5. A copy of this decisional document will be filed in his official record.
