Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of item 3 (Social Security Number (SSN)) of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his SSN as 309-XX-XXXX instead of 308-XX-XXXX. 2. The applicant states a typographical error in his SSN is repeated on various documents throughout his military record. 3. The applicant provides copies of his social security account number card, DD Form 214, and National Personnel Records Center (NPRC) Letter, dated 23 January 2006. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. His military record contains a DD Form 398 (Statement of Personal History) that he completed during his induction processing. Item 13 (Employment) contains a block for the SSN wherein he entered his SSN as "309-XX-XXXX." 3. On 6 April 1968, the applicant enlisted into the United States Army Reserve (USAR). The DD Form 4 (Enlistment Record-Armed Forces of the United States) and page one of the DA Form 20 (Enlisted Qualification Record) prepared upon his entry in the USAR lists his SSN as 308-XX-XXXX. 4. On 30 August 1968, he entered active duty training (ADT) and upon successful completion thereof, he was honorably released and transferred to his USAR unit. The DD Form 214 issued upon the release from ADT lists his SSN as 308-XX-XXXX. 5. His military record contains documents that lists his SSN as 309-XX-XXXX which include: * DA Form 41 (Record of Emergency Data) * Standard Form 88 (Report of Medical Examination) * Standard Form 89 (Report of Medical History) * USAREC Form 10 (Enlisted Evaluation Data Report) 6. Headquarters, Fifth U. S. Army, published Letter orders Number 03-3161, dated 14 March 1974, directing the applicant’s discharge from the USAR effective on 31 March 1974, and it lists his SSN as 308-XX-XXXX. On 31 March 1974, the applicant was discharged from the USAR. 7. The applicant provides a copy of his social security card. It lists his SSN as “309-XX-XXXX." DISCUSSION: The evidence of record clearly shows the applicant’s SSN is listed differently throughout his military record as 309-XX-XXXX and 308-XX-XXX. His DD Form 398 shows he disclosed his SSN as 309-XX-XXXX upon entry into the United States Army Reserve. This SSN is consistent with the SSN listed on some documents in his service record and the SSN listed on the social security card he provided.
