Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his induction date in item 16 (Date Inducted) and his date of entry in item 19c (Date of Entry). 2. The applicant states his DD Form 214 is missing his induction date and his date of entry. 3. The applicant provides copies of his DA Form 24 (Service Record), DA Form 20 (Enlisted Qualification Record, DD Form 47 (Record of Induction), and DD Form 214. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. A DD Form 47 (Record of Induction) shows the applicant was inducted into the Army of the United States on 18 July 1962. 3. On 26 June 1964, he was honorably released from active duty and transferred to United States Army Reserve. Item 16 of his DD Form 214 issued at the time is blank and Item 19c shows the entry "NA." REFERENCES: Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes the standardized policy for preparing and distributing the DD Form 214. It states the DD Form 214 provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. Section III of the regulation in effect at the time contained guidance on the preparation of the DD Form 214. It stated that item 16 documented the date of induction and item 19c documented the date an enlisted Soldier entered active duty other than by induction. DISCUSSION: 1. The applicant contends his DD Form 214 should contain a date in item 19c. Based on governing regulation, item 19c documented the date an enlisted Soldier entered active duty other than by induction. The applicant did not enlist; he was inducted. 2. Evidence shows the applicant was inducted into the Army of the United States on 18 July 1962.
