THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests the social security number (SSN) on his DD Form 214 (Report of Separation from Active Duty) be corrected to reflect the SSN listed on his social security card. 2. The applicant states the SSN XXX-XX-XXXX shown on his DD Form 214 is incorrect. His correct SSN is XXX-XX-XXXX. 3. The applicant provides his social security card. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. A Standard Form (SF) 88 (Report of Medical Examination), dated 7 October 1971, shows the applicant's SSN as XXX-XX-XXXX. 3. On 21 October 1971, the applicant enlisted in the Regular Army for 3 years. His DD Form 4 (Enlistment Contract - Armed Forces of the United States) shows his SSN as XXX-XX-XXXX. 4. The applicant's DA Form 20 (Enlisted Qualification Record) reflects a pen and ink change in which his SSN was changed to XXX-XX-XXXX instead of XXX-XX- XXXX. 5. A completed DD Form 1584 (National Agency Check Request), dated 19 November 1971, shows the applicant's SSN as XXX-XX-XXXX. 6. A DA Form 873 (Certificate of Clearance and/or Security Determination), dated 15 September 1972, shows the applicant's SSN as XXX-XX-XXXX. 7. A DD Form 398 (Statement of Personal History), dated 18 April 1973, shows the applicant entered his SSN as XXX-XX-XXXX. 8. Department of the Army, Headquarters, U.S. Army, Europe and Seventh Army, Special Orders Number 191, dated 10 July 1974, reassigned the applicant to a Transfer Station or Transfer Point for separation processing. The applicant is identified in the standard name line (SNL) with the SSN XXX-XX-XXXX. 9 Department of the Army, Headquarters, U.S. Army, Europe and Seventh Army Special Orders Number 205, dated 24 July 1974, amended the above orders changing the applicant's SSN in the SNL from XXX-XX-XXXX to XXX-XX-XXXX. 10. An SF 88, dated 27 September 1974, shows the applicant's SSN as XXX- XX-XXXX. 11. On 15 October 1974, the applicant was released from active duty. His DD Form 214 shows his SSN as XXX-XX-XXXX. 12. The social security card provided by the applicant shows his SSN as XXX- XX-XXXX. REFERENCES: Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. The regulation directs that the purpose of the separation document is to provide the individual with documentary evidence of his or her military service at the time of release from active duty, retirement, or discharge. It is important that information entered on the form be complete and accurate and reflects the conditions as they existed at the time of separation. DISCUSSION: 1. The applicant's DD Form 4, DA Form 873, and DD Form 214 show his SSN as XXX-XX-XXXX. However, his DA Form 20, DD Form 1584, DD Form 398, and two SF 88s show his SSN as XXX-XX-XXXX. 2. The fact that orders were issued amending his original orders for separation processing to change his SSN in the SNL to XXX-XX-XXXX shows the Army acknowledged an error had been made in the applicant's SSN in his military records. 3. The evidence confirms an error was made when his SSN was recorded on his DD Form 214. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by correcting Item 3 (Social Security Number) of his DD Form 214 (Report of Separation from Active Duty) to show the social security number listed on his social security card.
