Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge), for the period ending 18 May 2000, to show he was authorized the North Atlantic Treaty Organization (NATO) Medal and to show the dates of his foreign service in Bosnia-Herzegovina. 2. The applicant states he served with NATO on overseas operations from 1 September to 15 December 1999 (a period of 3 months and 15 days). 3. The applicant provides his DD Form 214, NATO Medal Certificate, and a Certificate of Appreciation. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 11 January 1999. 3. The applicant's Master Military Pay Account (MMPA), maintained by the Defense Finance and Accounting Service (DFAS), indicates he deployed to Bosnia-Herzegovina from 1 August to 31 December 1999. 4. The applicant was discharged on 18 May 2000. His DD Form 214 contains the following information: * Item 12f (Foreign Service), no entry that shows he was credited with any foreign service; * Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized), does not list the NATO Medal * Item 18 (Remarks), does not show he deployed in support of any named operations 5. The applicant provides a NATO Medal Certificate that shows he was awarded the NATO Medal for service with NATO operations in relation to the former Yugoslavia during the period 1 September to 15 December 1999. He also provides a Certificate of Appreciation that he received for dedication to duty and service to the 2nd Brigade Task Force, while assigned as part of Stabilization Force-6 in Bosnia Herzegovina. REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time of the applicant's active duty service, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It provided standardized policy for preparation of the DD Form 214 and stated: a. Item 12f, enter the total amount of foreign service completed during the period covered by the DD Form 214, b. Item 13, list awards and decorations for all periods of service in the priority sequence specified in Army Regulation 600-8-22 (Military Awards), and c. Item 18, for an active duty Soldier deployed to a foreign country with his or her unit during their continuous period of active service, enter the statement "SERVICE IN (name of country deployed) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)." DISCUSSION: 1. The applicant provides a certificate issued by NATO confirming he was awarded the NATO Medal for service with NATO operations in relation to the former Republic of Yugoslavia. 2. DFAS records show the applicant deployed to Bosnia-Herzegovina during the period 1 August to 31 December 1999. The applicant stated he served with NATO during the period 1 September to 15 December 1999, a period of 3 months and 15 days. Although the deployment dates provided by DFAS and the deployment dates stated by the applicant are slightly different, the dates provided by the applicant are consistent with the service dates shown on his NATO Medal Certificate. This foreign service was not included in item 12f or item 18 of his DD Form 214. 3. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. amending item 12f oh his DD Form 214 to show he was credited with completing 3 months and 15 days of foreign service; b. amending item 13 of his DD Form 214 to show he was authorized the North Atlantic Treaty Organization (NATO) Medal; and c. amending item 18 of his DD Form 214 by adding the entry "SERVICE IN BOSNIA HERZEGOVINA FROM 19990901-19991215."
