Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction to his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his unit as the 475th Quartermaster Group vice the 485th Quartermaster Group. In addition, he requests award of the Kuwait Liberation Medal, the Southwest Asia Service Medal, and any other awards he earned. 2. The applicant states a typographical error occurred during the preparation of his DD Form 214. 3. The applicant provides: * letter of support * DD Form 214 dated 19 June 1991 * self-authored statement * assignment order CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the United States Army Reserve (USAR) on 21 October 1988 for a period of 8 years. He completed initial entry training from 11 January to 5 June 1990 and was awarded military occupational specialty 52D (Power Generator Equipment Repairer). 3. On 27 September 1990 he was ordered to active duty in support of Operations Desert Storm and Desert Shield. On 19 June 1991 he was released from active duty and transferred to his USAR unit. He completed 8 months and 23 days of creditable active duty service. 4. The DD Form 214 issued to the applicant includes the following entries: * item 8a (Last Duty Assignment and Major Command) – shows 485th Quartermaster Group * item 12f (Record of Service – Foreign Service) – 7 months and 5 days * item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) – does not include the Kuwait Liberation Medal or the Southwest Asia Service Medal * item 18 (Remarks) – he served in Southwest Asia from 11 October 1990 to 12 May 1991 5. His official military personnel file (OMPF) contains a DD Form 215 issued on 25 March 1992 that includes the following pertinent corrections as indicated: * item 8a – Headquarters and Headquarters Detachment 475th Quartermaster Group, United States Army Forces Command * item 12f – "00701" or 7 months and 1 day * item 13 – adds the Southwest Asia Service Medal with three bronze service stars, the Kuwait Liberation Medal, and an overseas service bar 6. As this DD Form 215 corrected his unit of assignment (item 8a) this specific correction to his DD Form 214 will not be further discussed in this record of proceedings. REFERENCES: 1. Army Regulation 600-8-22 (Military Awards) provides Army policy, criteria, and administrative instructions for awards, service medals and ribbons, badges and unit decorations. a. The Kuwait Liberation Medal – Saudi Arabia was awarded by the Government of Saudi Arabia to Service members of the Armed Forces of the United States and authorized by the Department of Defense (DOD) on 3 January 1992. It is awarded to those who participated in Operation Desert Storm in Southwest Asia during the period 17 January to 28 February 1991. b. The Kuwait Liberation Medal – Government of Kuwait was awarded by the Government of Kuwait to Service members of the Armed Forces of the United States and authorized by DOD on 7 August 1995. It is awarded to those who served in support of Operations Desert Shield and Desert Storm in Southwest Asia between 2 August 1990 and 31 August 1993. 2. Department of the Army General Order Number 27, issued on 27 December 1994, awarded the Meritorious Unit Commendation to Headquarters and Headquarters Company, 475th Quartermaster Group for the period from 12 October 1990 to 12 April 1991. DISCUSSION: 1. In March 1992, the applicant was issued a DD Form 215 correcting his previously issued DD Form 214. The pertinent items corrected were item 8a (Last Duty Assignment and Major Command) and item 12f (Record of Service – Foreign Service) and item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized). He received the Southwest Asia Service Medal with three bronze service stars and the Kuwait Liberation Medal 2. At the time there was only one award of the Kuwait Liberation Medal authorized by DOD. In 1995, the DOD approved a second award and clarified the foreign government who awarded it. By regulation, the applicant is authorized the Kuwait Liberation Medal – Saudi Arabia and Kuwait Liberation Medal – Government of Kuwait for his service in support of Operations Desert Storm and Desert Shield. 3.
