THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of the social security number (SSN) recorded in section 32 (Remarks) of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) for the period ending 13 September 1963. 2. The applicant states, in effect, the SSN listed on his DD Form 214 should be "XXX-XX-XXXX" vice "XXX-XX-XXXX." 3. The applicant provides his social security card and DD Form 214. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army (RA) on 8 April 1959. His DD Form 4 (Enlistment Record-Armed Forces of the United States) did not list his SSN; it listed his service number instead. 3. He was honorably discharged from active duty on 14 September 1960 for immediate reenlistment. His DD Form 214 for this period of service listed his service number in item 2 (Service Number). Item 32 listed his SSN as "XXX-XX-XXXX." 4. On 15 September 1960, the applicant reenlisted in the RA. His DD Form 4 listed his service number again and not his SSN. 5. He was honorably released from active duty on 13 September 1963 and transferred to the U.S. Army Reserve (USAR) Control Group (Standby). His DD Form 214 for this period of service shows his SSN in item 32 as "XXX-XX-XXXX." 6. On 29 January 1973, the applicant enlisted in the Alabama Army National Guard (ALARNG). His DD Form 4 (Enlistment Contract – Armed Forces of the United States) shows in * item 1 (Service Number) – his SSN as "XXX-XX-XXXX" * item 49 (Prior Service) – his SSN of record from 9 April 1959 to 8 April 1964 was "XXX-XX-XXXX" 7. He was honorably released from the ALARNG on 26 July 1978. His National Guard Bureau (NGB) Form 22 (Report of Separation and Record of Service) listed his SSN as "XXX-XX-XXXX." 8. On 27 July 1978, the applicant enlisted in the USAR Ready Reserve for a period of one year. His DD Form 4 (Enlistment or Reenlistment Agreement – Armed Forces of the United States) listed his SSN as XXX-XX-XXXX." It is presumed he was honorably released from the USAR on 26 July 1979 absent any documentation showing the contrary. 9. His record contains the following documents listing his SSN as "XXX-XX-XXXX." * DA Form 2-1 (Personnel Qualification Record) * DD Form 2005 (Privacy Act Statement) 10. The applicant provides a copy of his social security card reflecting his SSN as "XXX-XX-XXXX." REFERENCE: Army Regulation 635-5 (Separation Documents), in effect at the time, established the standardized policy for preparing and distributing the DD Form 214. The regulation directs that the purpose of the separation document is to provide the individual with documentary evidence of his or her military service. It is important that information entered on the form is complete and accurate. DISCUSSION: The applicant's 27 July 1978 DD Form 4 and other source documents reflect his SSN as "XXX-XX-XXXX." This SSN is consistent with the social security card he provides. It appears both of his DD Forms 214 contain errors. His DD Forms 214 for the period ending 14 September 1960 and 13 September 1963 inadvertently listed the numbers "2" instead "4" as the first digit of his SSN. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending item 32 of his DD Forms 214 for the periods ending 14 September 1960 and 13 September 1963 to show the SSN "XXX-XX-XXXX."
