THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of item 3 (Social Security Number (SSN)) of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show the third digit of his SSN as "X" instead of "X." 2. The applicant states that his SSN was incorrectly transcribed on his DD Form 214. 3. The applicant provides copies of his social security account number card and DD Form 214. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. His military record contains a DD Form 398 (Statement of Personal History) that he completed during his induction processing. Item 13 (Employment) contains a block for the SSN wherein he entered his SSN to show the third digit of his SSN as "X." 3. On 3 October 1966, the applicant enlisted in the Regular Army (RA). The DA Form 20 (Enlisted Qualification Record) prepared upon his entry in the RA lists the third digit of his SSN as "X." 4. His military record contains some documents that list the third digit of his SSN as "X" and others that list it as "X." On 9 November 1969, the applicant was honorably released from active duty (REFRAD) having completed 3 years of creditable active duty service. The DD Form 214 issued upon his REFRAD the third digit of his SSN as "X." 5. The applicant provides a copy of his social security card. It lists the third digit of his SSN as "2.". DISCUSSION: The evidence of record clearly shows the third digit of his SSN is listed throughout his military record as "X" and "X." His DD Form 398 shows he disclosed the third digit of his SSN as "2" upon entry into the RA. This SSN is consistent with the SSN listed on some of the documents in his service record and the SSN listed on the social security card he provided. It appears an administrative error occurred during preparation of his DD Form 214. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his social security number as recorded on his DD Form 398 (Statement of Personal History) and his social security card.
