THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction of his DD Form 214 (Report of Separation from the Armed Forces of the United States) to show all missing awards and ribbons. 2. The applicant states, in effect, his DD Form 214 is missing some awards and ribbons related to his military service. 3. The applicant provides no additional evidence. CONSIDERATION OF EVIDENCE: Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. BOARD DATE: 22 May 2018 DOCKET NUMBER: AR20160007372 BOARD DETERMINATION/RECOMMENDATION: The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding to his DD Form 214 the Korea Defense Service Medal. I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. 1. 2. The applicant's complete military records are not available for review. A fire destroyed approximately 18 million service members' records at the National Personnel Records Center in 1973. It is believed that the applicant's records were lost or destroyed in that fire. However, there is sufficient documentation in a reconstructed record to conduct a fair and impartial review of this case. 3. The applicant's available military records contain the following: a. A DD Form 214 showing he was inducted into the Army of the United States and entered active duty on 24 June 1953. He served in military occupational specialty 1047 (Boiler Repairman). b. A DA Form 24 (Service Record) for the period from 24 June 1953 to 18 May 1955 showing in: * Section 4 (Service Outside Continental United States) – he served in Korea from 28 July 1954 to on or about 9 May 1955 * Section 9 (Medals, Decorations, and Citations) – National Defense Service Medal and Army Good Conduct Medal 4. The DD Form 214 also shows he was honorably released from active duty on 18 May 1955 and he was transferred to the U.S. Army Reserve. He completed 1 year, 10 months, and 25 days of active service, of which 10 months was foreign service. The DD Form 214 shows his awards as the National Defense Service Medal and Army Good Conduct Medal. REFERENCES: Army Regulation 600-8-22 (Military Awards) states the Korea Defense Service Medal is authorized for award to service members of the Armed Forces of the United States who have served on active duty in support of the defense of the Republic of Korea from 28 July 1954 to a date to be determined by the Secretary of Defense, for 30 consecutive or for 60 nonconsecutive days. DISCUSSION: His available military records confirm he served a qualifying period of service in Korea from July 1954 to May 1955 for award for Korea Defense Service Medal.
