Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his records to show his social security number (SSN) as "XXX-XX-XXXX" instead of "XXX-XX-XXXX." 2. The applicant states the SSN recorded on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) is incorrect. It is not the SSN he was issued and the entry appears to be the result of an administrative error. He just recently noticed that the SSN on his DD Form 214 is incorrect. 3. The applicant provides copies of his DD Form 214, social security card, and driver's license. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. A DD Form 4 (Enlistment Contract – Armed Forces of the United States) shows the applicant enlisted in the Regular Army on 6 January 1969 for a period of 3 years. Item 19 (SSN) shows the entry, "XXX-XX-XXXXX" 3. A DA Form 20 (Enlisted Qualification Record) shows in item 1 (Name and Service Number), in pertinent part, "XXX-XX-XXXX" The applicant reviewed the form on 10 January 1969 and he audited the form on 10 April 1970. 4. Headquarters, 2nd Basic Combat Training Brigade, U.S. Army Training Center, Fort Gordon, GA, Special Orders Number 33, dated 18 February 1969, in pertinent part, announced award of the Sharpshooter Marksmanship Qualification Badge with Rifle (M-16) Bar to the applicant. The Standard Name Line (SNL) shows the applicant's SSN as "XXX-XX-XXXX 5. Headquarters, U.S. Army School Center, Fort Benjamin Harrison, IN, Special Orders Number 126, dated 23 June 1969, in pertinent part, reassigned the applicant to the U.S. Overseas Replacement Station, Fort Dix, NJ, on 14 July 1960, for further assignment to Germany. The SNL shows the applicant's SSN as "XXX-XX-XXXX 6. A DD Form 214 shows the applicant entered active duty on 6 January 1969 and he was discharged on 18 February 1971. He had completed 2 years and 3 days of net active service this period. It also shows in item 3 (SSN) the entry, "XXX-XX-XXXX" 7. In support of his application the applicant provides the following documents. a. A copy of a social security card (issued on 1 March 2016) that shows the applicant was issued SSN "XXX-XX-XXXX." b. A copy of a Massachusetts driver's license (issued in April 2012), with an expiration date in April 2017, that shows the applicant's date of birth, but not his SSN. REFERENCES: Army Regulation 635-5 (Personnel Separations - Separation Documents), in effect at the time of the applicant's separation from active duty, prescribed policies and procedures regarding separation documents. It also established standardized policy for preparing and distributing the DD Form 214. Section III (Instructions for Preparation and Distribution of the Armed Forces of the United States Report of Transfer or Discharge) states, in pertinent part, that all available records will be used as a basis for the preparation of the DD Form 214, including the Enlisted Qualification Record, Officer Qualification Record, and orders. The instructions show for item 3, transcribe the SSN from the DA Form 2139 (Military Pay Voucher). DISCUSSION: 1. A DD Form 4 shows the SSN "XXX-XX-XXXX" was entered in the applicant's military service record at the time of his enlistment in the Regular Army. a. The SSN was recorded on other documents in his military service record. b. The SSN "XXX-XX-XXXX" was also entered in his military service record. c. His DD Form 214 shows the SSN "XXX-XX-XXXX" d. The social security card he was issued shows his SSN is "XXX-XX-XXXX" 2. Based on the evidence of record, it appears an administrative error was made in recording the applicant's SSN in his military service records at the time of his entry into military service. a. About one month after his enlistment, the applicant's correct SSN was used to identify him and, once again, about four months later. b. The SSN recorded on his DD Form 4 was recorded on his DD Form 214. BOARD DETERMINATION/RECOMMENDATION: The Board determined the evidence presented is sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by Issuing a DD Form 215 (Correction to DD Form 214) deleting the current entry from item 3 of his DD Form 214 and replacing the entry with the social security number shown on his social security card.
