Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of the social security number (SSN) entered on his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show "XXX-XX-XXXX" instead of "XXX-XX-XXXX." 2. The applicant states, in effect, the SSN listed on his DD Form 214 for the period ending 19 November 1982 is incorrect. The SSN should be "XXX-XX- XXXX" instead of "XXX-XX-XXXX." 3. The applicant provides his social security card. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 20 November 1979. His DD Form 4 (Enlistment/ Reenlistment Document) listed his SSN as "XXX-XX- XXXX." 3. His DA Form 2-1 (Personnel Qualification Record) lists his SSN as "XXX-XX-XXXX." He reviewed this form and signed it indicating the information it contained was correct. 4. His record contains the following documents listing his SSN as "XXX-XX-XXXX." * Orders Number 232-264, issued by U.S. Military Personnel Center – Korea, on 20 August 1981 * DA Form 428 (Application for Identification Card), dated 23 March 1982 * DD Form 93 (Record of Emergency Data), dated 2 July 1982 * Orders Number 192-32, issued by Headquarters III Corps and Fort Hood, TX, on 4 October 1982 5. He was honorably released from active duty on 19 November 1982 and transferred to the U.S. Army Reserve Control Group (Reinforcement). His DD Form 214 shows in item 3 (SSN) his SSN as "XXX-XX-XXXX." 6. The applicant provides a social security card showing his SSN as "XXX-XX-XXXX." REFERENCE: Army Regulation 635-5 (Separation Documents), in effect at the time, established the standardized policy for preparing and distributing the DD Form 214. The regulation directs that the purpose of the separation document is to provide the individual with documentary evidence of his or her military service. It is important that information entered on the form should be complete and accurate. With regard to item 3, the regulation required verification of accuracy with the SSN of record. DISCUSSION: 1. The evidence of record shows the applicant's SSN was listed as "XXX-XX-XXXX" upon his enlistment. He consistently used this SSN throughout his military service. He did not use the SSN "XXX-XX-XXXX" shown on his social security card at any time during his military service. 2. For historical purposes, the Army has an interest in maintaining the integrity of its records. The data and information contained in those records should reflect the conditions and circumstances that existed at the time the records were created. In the absence of a showing of material error or injustice, there is a reluctance to recommend that those records be changed. 3. The applicant is advised a copy of this decisional document will be filed in his official military personnel file. This should serve to clarify any questions or confusion in regard to the difference in the SSN recorded in his military records and the SSN shown on his social security card.
