THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, joint service credit for five non-consecutive tours to Colombia and Costa Rica. 2. The applicant states, in effect: a. As a Regular Army (RA) officer, he was not able to satisfy the active duty criteria for joint service credit, but asserts he would qualify as a Reserve Component (RC) officer. b. He contends this policy did not take into consideration scenarios, such as when officers are selected to return to the RA under the Limited Call to Active Duty program. (The Call to Active Duty Program is available to selected RC officers and results in the officer being brought on active duty as an RA officer.) c. On 27 September 2015, the Under Secretary of Defense issued an exception to policy memorandum that allowed serving lieutenant colonels (LTC) and colonels (COL) a one-time opportunity to request joint experience credit more than 12 months after the completion of that service. (A copy was not included.) d. This policy covered officers on active duty. Nevertheless, the joint service occurred while he was assigned to the RC. 3. Having had prior enlisted service in the RA and in the U.S. Army Reserve as a Reserve Officers' Training Corps Cadet, he was appointed as a commissioned officer in the RA. He executed his oath of office on 27 August 1993. 2. He was honorably discharged on 30 November 2001 and transferred to the Selected Reserve. 3. The following relevant documents are available in his official military personnel file (OMPF): a. DD Forms 214 for periods ending: * 27 August 2003 – service in Colombia from 9 March 2003 to 27 August 2003 * 22 June 2003 – service in Colombia from 1 October 2003 to 19 June 2004 * 22 September 2006 – foreign service not shown, but states he entered into and separated from active duty in Colombia; his mailing address after separation is the U.S. Embassy in Colombia * 25 September 2008 – service in Costa Rica from 10 October 2007 to 25 September 2008 b. DA Forms 67-9, indicating service in Colombia and Costa Rica, for the rated periods: * 1 December 2002 through 30 November 2003 – duty with the Planning Assistance Training Team (PATT), U.S. Military Group (USMILGP), Colombia, as a Logistics Planner and Assistant Team Member * 1 December 2003 through 22 June 2004 – duty with the PATT, Colombia, as a Logistics Planner and Assistant Team Member, directly supporting the Colombian Military * 23 June 2004 through 22 June 2005 – at start of the rated period (term not defined), served as plans and operations officer for USMILGP - Colombia * 24 June 2005 through 28 February 2006 – mentions he provided support to the USMILGP in Colombia (does not show how long) * 1 March 2006 through 22 September 2006 – duty with USMILGP - Costa Rica as a Traditional Commander's Activities Coordinator * 23 September 2006 through 22 September 2007 – duty with USODR (U.S. Office of Defense Representative) Costa Rica as a Traditional Commander's Activities Coordinator * 23 September 2007 through 19 September 2008 – duty with USSOUTHCOM (U.S. Southern Command), USODR Costa Rica, as a Traditional Commander's Activities Coordinator * 20 September 2008 through 11 June 2009 – duty with USSOUTHCOM as a Traditional Commander's Activities Coordinator - Costa Rica c. PO Number 097-001-10, dated 7 April 2010, issued by USSOUTHCOM, awarding him the DMSM for the period 28 February 2006 to 11 June 2009. The DMSM citation shows the award was given for meritorious service as Traditional Commander Activities Program Coordinator for Costa Rica from February 2006 to June 2009. 4. At some point in 2009, the applicant was accepted into the Call to Active Duty Program wherein he was reappointed as a RA officer and ordered to active duty. a. Orders Number A-05-914702, dated 22 May 2009, issued by the U.S. Army Human Resources Command (HRC), ordered him to active duty for an indefinite period. b. The order lists Procurement Program Number (PPN) C5 (commissioned officers voluntarily ordered to the Active Army from the USAR). c. His ORB indicates his current component as RA. 5. He was promoted to LTC effective 1 September 2010. 6. An official from HRC provided an advisory opinion, dated 25 July 2016, in which he essentially stated: a. Based on a review of HRC's records and the information provided, the official did not find sufficient basis to support the applicant's request. b. On 1 October 2015, the applicant requested joint credit for five non-consecutive tours, ranging in time from 9 March 2003 to 25 September 2008. He served three tours in Colombia, and two tours in Costa Rica. Based on the Joint Manpower Information System (JMIS), there is no record of the applicant having submitted any nominations for Experience - Joint Duty Assignment (E-JDA) points. c. Department of Defense Instruction (DODI) Number 1300.19 (DOD Joint Officer Management (JOM) Program), dated 4 March 2014, is cited as a reference. (1) Enclosure 6 (Joint Experience, Training, and Education), paragraph 2 (Joint Experience) subparagraph c, states an officer must submit joint experiences within 12 months of experience completion. (2) Change 2, dated 16 February 2010, authorized RC officers to submit any retroactive completed joint experiences that were more than 12 months old, as long as the submission was accepted on or prior to 30 September 2013. (3) According to JMIS, the applicant never submitted any joint experiences via the self-nomination website used for requesting joint credit. As such, he is no longer eligible to submit retroactive joint experiences for joint credit. 7. The Case Management Division, Army Review Boards Agency, provided the applicant a copy of the advisory opinion on 8 August 2016. He did not submit a response. REFERENCES: A memorandum, dated 27 September 2015, from the Under Secretary of Defense and addressed to the Joint Chiefs of Staff, subject: Exception to Policy Requests for Joint Experience Credit More than 12 Months After Experience Completion, addresses an exception to the policy outlined in DODI 1300.19. a. The Under Secretary authorized the Joint Chiefs to conduct a one-time, limited Joint Qualification System (JQS) Experience Panel for officers to request joint experience credit for joint experiences completed more than 12 months before their request. b. The panels could consider requests from active and RC officers of any service who were in the grade of O-5 or O-6 as of 27 September 2015. Additionally, the panels could only consider experiences gained after 1 October 2010. c. Any experiences not approved by this JQS Experience Panel could not be submitted for reconsideration by subsequent JQS Experience Panels. d. The panels had to be conducted no later than 1 May 2016. DISCUSSION: 1. The applicant requests, in effect, joint service credit for five non-consecutive tours to Colombia and Costa Rica. In support of his request he asserts, because he served in these locations while a USAR officer, he qualifies under a memorandum, dated 27 September 2015 and issued by the Under Secretary of Defense. 2. The evidence of record indicates he performed significant service in both Colombia and Costa Rica between 2003 and 2009. It appears, under the provisions of change 2, DODI 1300.19, he could have had this service considered for joint service credit had he submitted a request for retroactive credit by 30 September 2013. The HRC advisory, however, indicates he did not do so. 3. The memorandum issued by the Under Secretary of Defense, dated 27 September 2015, provides for an exception to the policy outlined in DODI 1300.19 by permitting RC officers in the grades of O-5 and O-6 to submit retroactive requests, but only for service performed after 1 October 2010. 4.
