Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests award of the Armed Forces Expeditionary Medal. 2. The applicant states he was with the 4th Cavalry of the 1st Infantry Division and he participated in the Cuban Missile Crisis in October 1962. He believes he is due the Armed Forces Expeditionary Medal. 3. The applicant provides a letter from the National Personnel Records Center (NPRC) and an Internet printout pertaining to the Armed Forces Expeditionary Medal. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 19 August 1960 and he held military occupational specialty 131.10 (Armor Crewman). He served in Korea from on or about 13 January 1961 to on or about 11 May 1962. 3. Following his Korea tour, he was reassigned to the 1st Reconnaissance Squadron, 4th Cavalry, 1st Infantry Division, Fort Riley, KS. 4. He was honorably released from active duty on 16 August 1963. His DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) shows he was awarded or authorized: * Expert Marksmanship Qualification Badge with Machine Gun Bar * Marksman Marksmanship Qualification Badge with Rifle Bar * Marksman Marksmanship Qualification Badge with Tank Weapon Bar * Vehicle Driver Badge 5. On 12 January 2009, he was issued a DD Form 215 (Correction to DD Form 214) that added the National Defense Service Medal and the Korea Defense Service Medal to his DD Form 214. 6. He provides a letter from NPRC advising him of the process to correct his military records. He also provides a computer printout regarding the Armed Forces Expeditionary Medal. REFERENCE: Army Regulation 600-8-22 (Military Awards) provides the criteria for award of the Armed Forces Expeditionary Medal. a. The Armed Forces Expeditionary Medal may be awarded to service members of the Armed Forces of the United States who, after 1 July 1958: (1) Participate, or have participated, as members of the U.S. military units in a U.S. military operation in which service members of any military department participate, in the opinion of the Joint Chiefs of Staff, in significant numbers. (2) Encounter during such participation foreign-armed opposition, or are otherwise placed, or have been placed, in such position that, in the opinion of the Joint Chiefs of Staff, hostile action by foreign armed forces were imminent even though it did not materialize. b. The Armed Forces Expeditionary Medal may be authorized for the following three categories of operations: (1) U.S. military operations; (2) U.S. operations in direct support of the United Nations (UN); or (3) U.S. operations of assistance for friendly foreign nations. c. Service members must be bona fide members of a unit participating in or be engaged in the direct support of the operation for 30 consecutive days in the area of operations (or for the full period when an operation is less than 30 days duration) or for 60 nonconsecutive days provided this support involved entering the area of operations or and meets one or more of the following criteria: (1) Be engaged in actual combat, or duty, which is equally as hazardous as combat duty, during the operation with armed opposition, regardless of time in the area. (2) Is wounded or injured and requires medical evacuation from the area of eligibility while participating in the operation, regardless of time. (3) Accumulates required days service (consecutive or nonconsecutive) while participating as a regularly assigned air crewmember of an aircraft flying sorties into, out of, within, or over the area in direct support of the military operation. One day’s service is credited for the first sortie flown on any day. Additional sorties flown on the same day receive no further credit. d. Qualifying service for this award includes participation/service in Cuba during the period 24 October 1962 to 1 June 1963. DISCUSSION: The applicant's record does not show he served as a bona fide member of a unit participating in or engaged in the direct support of the Cuban Missile Crisis for 30 consecutive days in the area of operations (Cuba) or for 60 nonconsecutive days; or that, if support was provided, he entered the area of operations; or that he was engaged in actual combat.
