THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests removal of his DA Form 1059 (Service School Academic Evaluation Report), dated 22 August 2014, from his Official Military Personnel File (OMPF). 2. The applicant states, in effect, he later successfully completed the Army Recruiting Course. 3. The applicant provides: * two DA Forms 1059, dated 22 August 2014 and 12 December 2014 * U.S. Army Soldier Support Institute Recruiting and Retention School Diploma CONSIDERATION OF EVIDENCE: 1. Having prior honorable service in the U.S. Army Reserve and Army National Guard, the applicant enlisted in the Regular Army on 3 September 2009 in the pay grade of E-5. 2. On 1 January 2011, he was promoted to the rank/grade of staff sergeant/E-6. 3. His DA Form 1059, dated 22 August 2014, filed in performance folder of his OMPF shows he did not achieve the minimum standard of 80 percent on the Enlistment Eligibility Examination of the Army Recruiting Course held during the period 11 August 2014 through 26 September 2014. 4. His DA Form 1059, dated 12 December 2014, filed in performance folder of his OMPF shows he successfully completed the Army Recruiting Course held during the period 28 October 2014 through 12 December 2014. REFERENCES: 1. Army Regulation 623-3 (Evaluation Reporting System) prescribes the policies for completing evaluation reports that support the Evaluation Reporting System. The DA Form 1059 is used to document the performance, accomplishments, potential, and limitations of Soldiers while attending military schools and courses of instruction or training. Commandants of Army (or other Department of Defense branch) schools (also known as Service schools) and noncommissioned officer academies will be responsible for preparing the DA Form 1059 and submitting them to Headquarters, Department of the Army (or appropriate headquarters) to arrive no later than 90 days after the student's graduation or termination from the school or academy. 2. Army Regulation 600-8-104 (Army Human Resource Records Management) prescribes the policies and mandated operating tasks for the Army Military Human Resource Records Management Program. It states that once placed in the OMPF, a document becomes a permanent part of that file. The document will not be removed from the OMPF or moved to another part of the OMPF unless directed by competent authority. Instructions state the DA Form 1059 is to be filed in the performance section of the OMPF. DISCUSSION: 1. The evidence of record shows the applicant did not complete the Army Recruiting Course held during the period 11 August 2014 through 26 September 2014. His DA Form 1059, dated 22 August 2014, correctly records his academic failure in accordance with the governing regulation. 2.
