Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests a DA Form 4980-14 (Army Commendation Medal (ARCOM) Certificate) annotated with Permanent Orders Number 195-04 be removed from his official military personnel file (OMPF). 2. The applicant states the ARCOM Certificate in question was not presented to him and was superseded by a DA Form 4980-12 (Meritorious Service Medal (MSM) Certificate) annotated with Permanent Orders Number 223-06. The ARCOM Certificate was uploaded into the interactive Personnel Electronic Records Management System (iPERMS) before it could be replaced by the correct award. He's made numerous attempts at the unit and installation level to have this erroneous certificate removed from his OMPF. 3. The applicant provides: * a memorandum for record (MFR) from his brigade commander, dated 26 April 2016 * the subject ARCOM Certificate annotated with Permanent Orders Number 195-04, dated 14 July 2015 * his MSM Certificate annotated with Permanent Orders Number 223-06, dated 11 August 2015 CONSIDERATION OF EVIDENCE: 1. The applicant was appointed as a commissioned officer in the Regular Army, in the military intelligence branch, on 31 May 2008. He was promoted to first lieutenant on 30 November 2009 and captain on 1 July 2011. 2. Permanent Orders Number 195-04, issued by Headquarters, 2nd Brigade, 1st Infantry Division, awarded him the ARCOM on 14 July 2015 for exceptionally meritorious service during the period 1 May 2012 through 31 August 2015. This certificate is signed by the brigade commander. According to iPERMS, it was uploaded into the applicant's OMPF on 11 August 2015. 3. Permanent Orders Number 223-06, issued by Headquarters, 1st Infantry Division on 11 August 2015, awarded him the MSM for exceptionally meritorious service during the period 28 June 2012 through 31 August 2015. This certificate is signed by the division commander. According to iPERMS, it was uploaded into the applicant's OMPF on 23 December 2015. 4. The applicant provides an MFR from his brigade commander, who signed the subject ARCOM Certificate, wherein he states the applicant's ARCOM Certificate, annotated with Permanent Orders Number 195-04, was erroneously uploaded into iPERMS prior to his departure from the brigade at Fort Riley, Kansas. He further states the applicant was awarded an MSM for his permanent change of station (PCS) award and that certificate is properly filed in iPERMS. REFERENCES: Army Regulation 600-8-104 (Army Military Human Resource Records (AMHRR) Management) prescribes the policies and mandates operating tasks for the Military Personnel Information Management/Records Program of the Military Personnel System. It provides detailed guidance and instructions with regard to the initiation, composition, maintenance, changing, access to, and transfer of the AMHRR, which includes the OMPF. Table B-1 governs what is authorized for filing on the performance portion of the OMPF. The Army Board for Correction of Military Records may direct removal or movement of documents filed in the OMPF in the interest of justice or equity. DISCUSSION: The evidence of record shows the applicant's OMPF contains an ARCOM Certificate and an MSM Certificate that, essentially, cover the same period of service. Both were presented as PCS awards; however, it appears the MSM was approved by a higher authority after the ARCOM had already been approved.
