THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show she served in a designated imminent danger pay area and in Iraq from 15 August 2005 to 25 November 2006. 2. The applicant states she recently discovered that the DD Form 214 she was issued on 4 June 2009 does not show she served in Iraq or in a designated imminent danger pay area. 3. The applicant provides copies of her: * DD Form 214 * DA Form 4980-12 (Meritorious Service Medal Certificate) * Valorous Unit Award documents * Marriage Certificate * DA Form 4037 (Officer Record Brief) * DD Form 214 (Worksheet) CONSIDERATION OF EVIDENCE: 1. The applicant is currently serving as a Regular Army commissioned officer, in the rank of captain (O-3), in the Medical Service Corps. 2. A DD Form 214 shows she entered active duty this period on 24 June 1996 and she was honorably discharged on 4 June 2009 to accept a commission in the U.S. Army. She had completed 12 years, 11 months, and 11 days of net active service this period. Item 18 (Remarks) fails to show she – * served in a designated imminent danger pay area * deployed with her unit in support of a combat operation 3. In support of her application the applicant provides the following documents: a. DA Form 4980-12 that shows Headquarters, 101st Airborne Division (Air Assault), Tikrit, Iraq, Permanent Order Number 068-121, dated 9 March 2006, awarded her the Meritorious Service Medal for meritorious service with Brigade Support Medical Company, 172nd Brigade Support Battalion, from 15 August 2005 to 14 August 2006. b. Headquarters, U.S. Army Human Resources Command, Alexandria, VA, memorandum, dated 29 August 2007, subject: Valorous Unit Award – Permanent Orders; DA Form 4980-16 (Valorous Unit Award Certificate), dated 15 October 2007; and DA Form 7549 (Unit Award Citation Certificate) that show permanent orders awarded the Valorous Unit Award to Headquarters and Headquarters Company, 172nd Infantry Brigade Combat Team and its subordinate units, including 2nd Battalion, 1st Infantry Regiment, for the period 16 August 2005 to 3 December 2006. c. Commonwealth of Virginia, Marriage Register, that shows the applicant (Michelle Lee L___) married Clarence Leon N___, Jr. on 20 March 2013. d. The applicant's Officer Record Brief, dated 25 April 2016, that shows in section I (Assignment Information), Overseas/Deployment/Combat Duty, she deployed and served in Iraq for a period of 15 months (End Date: 25 November 2006). e. A DD Form 214 (Worksheet) that shows she entered active duty this period on 5 June 2009 and will be honorably retired from active duty on 30 November 2016 based on early retirement from service. She will have completed 7 years, 5 months, and 26 days of net active service this period and 12 years, 11 months, and 11 days of total prior active service. It also shows in item 18: * Served In A Designated Imminent Danger Pay Area * Service in Iraq from 26 October 2009 to 15 October 2010 4. The Defense Finance and Accounting Service confirmed the applicant received hostile fire pay/imminent danger pay (HFP/IDP) and combat zone tax exclusion from 15 August 2005 through 25 November 2006 for Kuwait. REFERENCES: Army Regulation 635-5 (Personnel Separations – Separation Documents), in effect at the time, prescribed the separation documents that must be prepared for Soldiers on retirement, discharge, release from active duty service, or control of the Active Army. It contains item-by-item instructions for completing the DD Form 214. It shows for item 18: * for a Soldier who served in a HFP/IDP area, enter: "SERVED IN A DESIGNATED HOSTILE FIRE PAY AREA" or "SERVED IN A DESIGNATED IMMINENT DANGER PAY AREA." * for an active duty Soldier who deployed with his/her unit during their continuous period of active service enter: "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates, for example YYYYMMDD-YYYYMMDD)." DISCUSSION: The evidence of record shows the applicant deployed with her unit to an imminent danger pay area (i.e., Kuwait and Iraq) during the period 15 August 2005 to 25 November 2006. The evidence of record also shows this information is authorized for entry in item 18 of the DD Form 214.
