Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, payment of Assignment Incentive Pay (AIP). 2. The applicant states she was granted an exception to policy (ETP) for AIP based on an extension of her foreign service tour in Korea; however, she did not receive the AIP. She attempted to resolve the matter while she was still in Korea, but she was never paid. 3. The applicant provides copies her assignment/reassignment orders and approved ETP for AIP. CONSIDERATION OF EVIDENCE: 1. The applicant is currently serving as a commissioned officer in the Regular Army in the rank of major (Army Nurse Corps). 2. In support of her application the applicant provides the following documents. a. Headquarters, 65th Medical Brigade, Orders Number 303-01, dated 30 October 2013, that show she was assigned to the 65th Medical Replacement Inbound (Korea) on 29 October 2013. It also shows she was further assigned to Area II, 121st General Hospital, Yongsan, Korea, on 30 October 2013, in area of concentration (AOC) 66H (Medical-Surgical Nurse). b. DA Form 4187 (Personnel Action), dated 30 October 2013, shows the Adjutant, 121st Combat Support Hospital (CSH), released the applicant from 121st CSH and reassigned her to the 150th Minimal Care Detachment with a reporting date of 30 October 2013. c. DA Form 4187, dated 15 October 2014, showing the Strength Manager, 121st CSH, released the applicant from the 150th Minimal Care Detachment and reassigned her to U.S. Army Medical Department Activity-Korea with a reporting date of 15 October 2014. d. Headquarters, 65th Medical Brigade (Korea), memorandum, dated 20 October 2014, subject: ETP for AIP pertaining to the applicant, shows her request for an ETP request for AIP was approved by the U.S. Army Human Resources Command (HRC). It also shows the applicant's date eligible to return from overseas (DEROS) was adjusted from 27 October 2014 to 27 October 2015. e. A "Corrected Copy" of the U.S. Army Installation Management Command, Pacific Region, U.S. Army Garrison-Yongsan, Military Personnel Division, Orders 238-2101, dated 26 August 2015, reassigned the applicant from the U.S. Army Medical Department Activity-Korea to Walter Reed National Military Medical Center, Bethesda, MD (with temporary duty enroute to Fort Sam Houston, TX). The "For Army Use" section of these orders show an "Availability Date" of 14 September 2015. 3. In the processing of this case an advisory opinion was obtained from the Chief, Compensation and Entitlements, Office of the Deputy Chief of Staff G-1, Washington, DC. a. The advisory official recommends administrative relief. b. The advisory official states in accordance with All Army Activities message 121/2013, Part II (2), the applicant qualified for the AIP (Korea) after she received an approved ETP for AIP. If the Board corrects the applicant's record, she would be entitled to AIP in the amount of $300 per month for the period 28 October 2014 through 15 September 2015. 4. On 1 July 2016, the applicant was provided a copy of the advisory opinion in order to allow her the opportunity to submit comments or a rebuttal. The applicant did not provide a response. REFERENCES: Army Regulation 37-104-4 (Military Pay and Allowances Policy), Chapter 20 (Settlement Actions Resulting from Correction of Records by the Army Board for Correction of Military Records (ABCMR)), provides that only the Director, Defense Finance and Accounting Service, may make settlement actions affecting the military pay accounts of Soldiers as a result of correction of records by the ABCMR under the provisions of Army Regulation 15-185 (ABCMR). DISCUSSION: 1. The applicant contends that she should be paid retroactive AIP because she was granted an ETP for AIP, but she was never paid. 2. Records show the applicant served an initial assignment (overseas tour) in Korea with the 150th Minimal Care Detachment in AOC 66H from 30 October 2013 through 14 October 2014. a. She was reassigned to the U.S. Army Medical Department Activity-Korea on 15 October 2014. b. Based on the follow-on assignment in Korea, HRC approved an ETP for AIP pertaining to the applicant and adjusted her DEROS from 27 October 2014 to 27 October 2015. c. She completed her overseas tour in Korea on 15 September 2015. d.
