THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to reflect his social security number (SSN) as XXX-XX-xxxx. 2. The applicant states it appears a typographical error occurred when entering the social security number on his DD Form 214. 3. The applicant provides copies of his DD Form 214 and social security card. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 14 July 1964. His DD Form 4 (Enlistment Record – Armed Forces of the United States) shows he was assigned a service number. His SSN is not recorded on this document. 3. Item 9 (SSN) of his DA Form 41 (Record of Emergency Data) shows his SSN as XXX-XX-xxxx. 4. He was honorably released from active duty effective 13 July 1967 and transferred to the U.S. Army Reserve Control Group (Reinforcement) to complete his military service obligation. 5. Item 3 (SSN) of his DD Form 214 shows his SSN as XXX-XX-xxxx. 6. Item 10 (Selective Service Number) of his DD Form 214 shows his selective service number as 1-XXX-XX-xxxx. 7. Office of the Adjutant General, U.S. Army Administration Center, Letter Orders Number 07-1011760, dated 1 July 1970, discharged him from the USAR Control Group (Standby Reserve). His SSN is shown as XXX-XX-xxxx. 8. His available records do not contain a DA Form 2139 (Military Pay Voucher). 9. He provided his social security card showing his SSN as XXX-XX-xxxx. REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents that must be prepared for Soldiers on retirement, discharge, or release from active duty service or control of the Active Army. It established standardized policy for preparing and distributing the DD Form 214. The general instructions stated all available records would be used for preparation of the DD Form 214. The specific instructions stated to transcribe the SSN from the individual's DA Form 2139. DISCUSSION: 1. The applicant's records contain a DA Form 41 showing his SSN as XXX-XX-xxxx. 2.
