Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests removal of a DA Form 1059 (Service School Academic Evaluation Report (AER)) for the period 17 October 2011 through 18 November 2011 (hereafter referred to as the contested AER) from her official military personnel file (OMPF). 2. The applicant states she received the contested AER while her primary military occupational specialty (PMOS) was 92G (Food Service Specialist). a. Currently, her PMOS is 42R (Army Band Person) and she no longer serves in the food service operations field. While the document has been in her record for several years, she was not aware that she could request removal until recently when her records were reviewed by her command sergeant major in preparation for the most recent sergeant first class (SFC)/E-7 promotion board. b. She did not realize the document was showing in her performance file. Nor did she realize it could have been a determining factor as to why she was not selected for promotion to SFC during her past three considerations. As an Army musician, she would like the best chance possible in order to move on. 3. The applicant provides: * the contested AER * Army Good Conduct Medal (3rd Award) orders, dated 16 November 2011 * Equal Opportunity Leaders Course Certificate of Training, dated 15 December 2012 * DA Forms 4980-14 (Army Commendation Medal Certificate) * PMOS orders, dated 4 August 2015 * DA Form 1059 for the period 1 June 2016 through 7 August 2015 * Army Basic Music Course, Class 15-003, Certificate of Training, dated 7 August 2015 * Master Resilience Training Course Certificate, dated 5 February 2016 * six Noncommissioned Officer Evaluation Reports CONSIDERATION OF EVIDENCE: 1. The applicant is a prior service member who reenlisted in the Regular Army on 17 February 2006. She is currently serving on active duty in the rank/grade of staff sergeant (SSG)/E-6. 2. The contested AER for the period 17 October 2011 through 18 November 2011 shows she failed to achieve course standards in the Advanced Culinary Skills Course due to lack of knowledge of basic culinary principles. This form was filed in the performance section of her OMPF on 14 December 2011. 3. Orders 216-02, issued by Headquarters, U.S. Army School of Music, on 4 August 2014, show the applicant was awarded PMOS 42R and secondary MOS 92G effective 7 August 2015 or upon her completion of MOS training in U.S. Army Formal Schools Course #450-42R10. 4. An AER covering the period 1 June 2015 through 7 August 2015 shows the applicant successfully completed the Army Basic Music Course, Class 15-003. REFERENCES: Army Regulation 600-8-104 (Army Military Human Resource Records Management) prescribes the policies governing the OMPF, the military personnel records jacket, the career management individual file, and Army personnel qualification records. Paragraph 3-6 of this regulation states that once a document is placed in the OMPF it becomes a permanent part of that file and will not be removed from that file or moved to another part of the file unless directed by the proper authorities listed in the regulation. Table 3-1 (Composition of the OMPF) of this regulation shows a DA Form 1059 is to be filed in the performance section of the OMPF. DISCUSSION: 1. The applicant requests removal of the contested AER from her OMPF. She contends she is not serving in the food service field. 2. There is no evidence the contested AER was improperly issued or that it was improperly filed in the applicant's OMPF. The evidence confirms she was removed from the Advanced Culinary Skills Course she attended. 3. Once a document is placed in the OMPF it becomes a permanent part of that file and will not be removed from that file or moved to another part of the file unless directed by the proper authorities listed in the regulation.
