The applicant requests the Master Parachutist Badge be added to his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) with an effective date of 15 December 1964. 2. The applicant states he executed the requirements for eligibility of the Mater Parachutist Badge. THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records and documents from his official military personnel file (OMPF). 2. Evidence from the applicant's service record, and Department of the Army (DA) and Department of Defense (DOD) records and systems: * DA Form 24 (Service Record) * DA Form 20 (Enlisted Qualification Record) * DA Form 1307 (Individual Jump Record) * DD Form 214 REFERENCES: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 672-5-1 (Military Awards), in effect at the time, set forth requirements for award of the Master Parachutist Badge. The individual must have been rated excellent in character and efficiency and met the following requirements: a. Participated in a minimum of 65 jumps to include: * 25 jumps with combat equipment * four night jumps with one as jumpmaster of a stick * five mass tactical jumps which culminated in an airborne assault problem with a unit equivalent to a battalion or larger, a separate company/battery, or an organic staff of regimental size or larger. The individual must fill a position commensurate with his rank or grade during the problem b. Either graduated from the Jumpmaster Course of the Airborne Department of the Infantry School or the jumpmaster school of a separate airborne battalion or larger airborne unit, or served as jumpmaster on one or more combat jumps or as jumpmaster on 33 noncombat jumps. c. Had served on jump status with an airborne unit or other organization authorized parachutists for a total of at least 36 months. DISCUSSION: 1. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. On 22 December 1961, the applicant enlisted in the Regular Army for 3 years. He completed basic combat and advanced individual training and was awarded military occupational specialty 112.07 (Heavy Weapons Infantry). 3. On 25 May 1962, the applicant completed Basic Airborne Training. 4. On 30 May 1962, the applicant was assigned to Company C, 2nd Battalion (Airborne), 503rd Infantry. On 23 June 1964, he was assigned to Company B, 2nd Battalion (Airborne), 504th Infantry and remained assigned until his release from active duty. 5. He was assigned to an airborne unit for a total of 30 months and 16 days. 6. The applicant was rated excellent in conduct and efficiency throughout his period of service. 7. The applicant's DA Form 1307 covers a period from 22 May 1962 - 30 October 1964 and records a total of 24 jumps to include: * 15 jumps with combat equipment * three night jumps including one administrative jump as jumpmaster * five mass tactical jumps 8. There is no evidence in the applicant's Military Personnel Records Jacket (MPRJ) that he graduated from a jumpmaster course. 9. On 15 December 1964, the applicant was released from active duty by reason of completing his term of service. He completed 2 years, 11 months, and 24 days of active service that was characterized as honorable.
