Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests the "Army Reserve Good Conduct Medal," hereafter known as the Army Reserve Components Achievement Medal. 2. The applicant states he faithfully and honorably served for 3 years and did not received the Army Reserve Components Achievement Medal. He states this is a logistic error or due to a change in staff [at his unit] or simply overlooked. His family would like to display his awards and he would like all his awards to be true and correct. 3. The applicant did not provide evidence in support of his application. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. On 31 July 1990 the applicant enlisted in the Army National Guard (ARNG) and concurrently in the Pennsylvania ARNG for a period of 3 years. 3. On 23 July 1991 he entered active duty for training. On 25 October 1991 he completed his training and was released from active duty. He received a DD Form 214 (Certificate of Release or Discharge from Active Duty) for this period of service showing his service was honorable. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) does not show the ARCAM. 4. On 30 July 1993 orders were published by the PAARNG discharging the applicant from the ARNG and reassigning him to the U.S. Army Reserve (USAR) Control Group (Annual Training) to complete his statutory military service obligation. Concurrently he received a National Guard Bureau (NGB) Form 22 (Report of Separation and Record of Service) showing he completed 3 years of honorable service for pay purposes. Item 15 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded this Period) does not show the ARCAM. REFERENCES: Army Regulation 600-8-22 (Military Awards) states the Army Reserve Components Achievement Medal is awarded for exemplary behavior, efficiency, and fidelity while serving as a member of an ARNG or USAR troop program unit or as an individual mobilization augmentee. Military personnel in the rank of colonel and below are eligible for this award provided they meet the award criteria. Individuals must have completed 4 years of qualifying service on or after 3 March 1972 and before 28 March 1995. Beginning on 28 March 1995, the period of qualifying service for award of the Army Reserve Components Achievement Medal was reduced from 4 to 3 years. This change is not retroactive. Such years of qualifying service must have been consecutive. The approval authority for this award is the Soldier's unit commander. Orders are not published for this medal rather a memorandum signed by the unit commander is filed in the Soldier's personnel record. DISCUSSION: At the time of the applicant's service the criteria for the Army Reserve Components Achievement Medal was 4 years of consecutive service.
