Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 2 December 1983 to show the following awards: * Combat Medical Badge * Army Commendation Medal * Army Achievement Medal * Armed Forces Expeditionary Medal (Grenada) 2. The applicant states these awards are not shown on his DD Form 214. He was released from active duty before the awards were issued. 3. The applicant provides: * two certificates of service * Combat Medical Badge orders * Army Commendation Medal Certificate and orders * Army Achievement Medal Certificate and orders * DD Form 214 for the period ending 2 December 1983 * letter from a Member of Congress, dated 16 February 2016 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the U.S. Army Reserve under the Delayed Entry Program on 20 October 1980. He was discharged from the U.S. Army Reserve Delayed Entry Program on 3 December 1980 for immediate enlistment in the Regular Army. He enlisted in the Regular Army on 4 December 1980 for a period of 3 years. 3. He provided a certificate of service showing he was deployed with the 82d Airborne Division to Grenada during the period 28 October 1983 to 4 November 1983 as part of the U.S. Forces deployed to rescue American citizens and restore a democratic form of government. 4. On 2 December 1983, he was honorably released from active duty. 5. His DD Form 214 shows he was awarded or authorized the: * Army Service Ribbon * Parachutist Badge * Expert Marksmanship Qualification Badge with Pistol Bar (.45 caliber) * Army Good Conduct Medal * Marksman Marksmanship Qualification Badge with Rifle Bar (M-16) * Multinational Force and Observers Medal 6. Headquarters, 82d Airborne Division, Permanent Orders 223-1, dated 23 December 1983, awarded him the Combat Medical Badge for the period 24 October 1983 to 2 November 1983. (Note: The last four digits of his social security number are incorrect on these orders; however, these orders are contained in his Official Military Personnel File.) 7. Headquarters, 82d Airborne Division, Permanent Orders 7-151, dated 16 January 1984, awarded him the Army Commendation Medal for meritorious service during the period 20 October 1980 to 3 December 1983. 8. Headquarters, 82d Airborne Division, Permanent Orders 9-143, dated 18 January 1984, awarded him the Army Achievement Medal for meritorious achievement during the period 7 February 1983 to 1 August 1983. REFERENCES: Army Regulation 600-8-22 (Military Awards) states prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. The Armed Forces Expeditionary Medal is awarded for qualifying service after 1 July 1958 in U.S. military operations, U.S. operations in direct support of the United Nations, and U.S. operations of assistance for friendly foreign nations. Qualifying service for this award includes participation in Operation Urgent Fury in Grenada during the period 23 October 1983 through 21 November 1983. Qualifying service for non-unit direct support personnel in Grenada is 6 consecutive or 12 nonconsecutive days. DISCUSSION: 1. Orders show the applicant was awarded the Combat Medical Badge, Army Commendation Medal, and Army Achievement Medal. His DD Form 214 for the period ending 2 December 1983 does not show these awards. 2. The evidence of record shows he deployed to Grenada during the period 28 October 1983 to 4 November 1983 as part of the U.S. Forces deployed to rescue American citizens and restore a democratic form of government. He met the eligibility criteria for award of the Armed Forces Expeditionary Medal.
