The applicant requests reconsideration of the denial of his previous request for award of the Purple Heart. 2. The applicant states he was never submitted for the Purple Heart by his commanding officer while serving on active duty. THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records and a copy of the Daily Staff Journal or Duty Officer's Log of 1st Battalion, 8th Cavalry for the period 0001, 4 July 1967 to 2400, 4 July 1967 2. Evidence from the applicant's service record, and Department of the Army (DA) and Department of Defense (DOD) records and systems: * DD Form 47 (Record of Induction) * DA Form 20 (Enlisted Qualification Record) * DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) ? REFERENCES: 1. Army Regulation 600-200 (Enlisted Personnel Management System), in effect at the time, stated, in pertinent part, that a brief description of wounds or injuries (including injury from gas) requiring medical treatment that were received through hostile or enemy action, including those requiring hospitalization would be entered in item 40 (wounds) of the DA Form 20. This regulation further stated that the date the wound or injury occurred would also be placed in item 40. 2. Army Regulation 672-5-1 (Military Awards), then in effect, prescribed Army policy, criteria, and administrative instructions concerning individual and unit military awards. The Purple Heart was awarded to any member of an Armed Force or any civilian national of the United States who while serving under competent authority in any capacity with one of the U.S. Armed Services had been wounded, killed, or who had died as a result of a wound sustained as a result of hostile action. Substantiating evidence must be provided to verify that the wound was the result of hostile action, the wound must have required treatment by medical personnel, and the medical treatment must have been made a matter of official record. DISCUSSION: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20140007620 on 4 December 2014. 2. On 22 July 1966, the applicant was inducted into the Army of the United States. 3. The applicant was assigned to Company D, 1st Battalion, 8th Cavalry in the Republic of Vietnam from 11 January 1967 to 6 January 1968. 4. The applicant provided a copy of the Daily Staff Journal or Duty Officer's Log for the 1st Battalion, 8th Cavalry for the period 0001, 4 July 1967 to 2400, 4 July 1967. According to the journal at: * 1600 - 5 EM (enlisted members) were wounded in action (WIA) and 1 EM was killed in action (KIA) due to a mine. No names were indicated. * 1850 - A Company reported an individual stepped on a 105 round with trip wire attached and an EM tripped on a booby trap made up of either a concussion grenade or small land mine. No mention of any WIA or KIA was entered. * 2252 - D Company reported receiving automatic weapons fire from AK-47 from the north and grenades from the east. They had 1 WIA slightly wounded did not require medical evacuation. The name of the WIA was not entered. Friendly artillery was being called in the general vicinity. 5. Item 40 (Wounds) of his DA Form 20 does not show any entries for wounds or injuries received as a result of hostile or enemy action. 6. On 19 July 1968, the applicant was released from active duty. He completed 1 year, 11 months, and 28 days of active service that was characterized as honorable. 7. The applicant's service medical records were not available for review. 8. The applicant's name does not appear on the Vietnam casualty roster. 9.
