Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show award of the Armed Forces Expeditionary Medal (AFEM). 2. The applicant states his expeditionary medal is not listed on his DD Form 214 for his service in Cuba and Berlin, Germany. 3. The applicant provides: * DD Form 214 * Standard Form 180 (Request Pertaining to Military Records) * letter from the National Personnel Records Center, dated 1 June 2016 * letter of appreciation, dated 29 July 1965 * letter from the U.S. Army Security Agency Europe, dated 13 September 1965 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 6 September 1962. 3. Section 5 (Service Outside Continental United States) of his DA Form 24 (Service Record) shows he served in Germany from 14 March 1963 to 11 August 1965. 4. On 12 August 1965, he was honorably released from active duty. 5. His DD Form 214 does not show award of the AFEM. 6. There is no evidence showing he served in Cuba or Berlin, Germany. 7. He provided: a. A letter of appreciation from the Commanding Officer, U.S. Army Security Agency, Communications Unit Europe, dated 29 July 1965, for his exceptional performance of duty as a communication specialist. b. A letter from the Assistant Adjutant, U.S. Army Security Agency Europe, dated 13 September 1965, stating he was awarded a certificate of achievement for his outstanding contribution to Headquarters, U.S. Army Security Agency, Europe. REFERENCES: Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. The AFEM is awarded for qualifying service after 1 July 1958 in U.S. military operations, U.S. operations in direct support of the United Nations, and U.S. operations of assistance for friendly foreign nations. Qualifying service for this award includes service in: * Berlin from 14 August 1961 to 1 June 1963 * Cuba from 24 October 1962 to 1 June 1963 DISCUSSION: 1. The applicant requests correction of his DD Form 214 to show award of the AFEM for his service in Cuba and Berlin, Germany. He provided two letters in support of his claim; however, these letters do not show he served in Cuba or Berlin, Germany. 2.
