Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests the addition of the Parachutist Badge to his DD Form 214 (Report of Separation from Active Duty). 2. The applicant states he went to basic training at Fort Knox, KY. He then trained at Fort Polk, LA in military occupational specialty (MOS) 11B (Infantryman). He proceeded to Fort Benning, GA for jump school where he earned his Parachutist Badge. He was assigned to Fort Bragg, NC where he made two jumps with his unit. 3. The applicant states he provided a photograph of himself in basic airborne training. However, a review of his application file failed to show the picture was provided as stated. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. On 25 April 1973 the applicant enlisted in the Regular Army. He trained and was qualified in MOS 11B. 3. Special Orders Number 191 issued by Headquarters, The School Brigade, U.S. Army Infantry School on 2 October 1973 awarded the applicant the Parachutist Badge effective 17 September 1973. 4. On 14 February 1975 the applicant was discharged under the expeditious discharge program. He was issued a DD Form 214 which does not list the Parachutist Badge as an authorized badge. REFERENCES: 1. Army Regulation 600-8-22 (Military Awards) states award of the basic Parachutist Badge requires that an individual must have satisfactorily completed the prescribed proficiency tests while assigned or attached to an airborne unit or the Airborne Department of the Infantry School or have participated in at least one combat parachute jump. Announcement in orders is required by the appropriate award approval authority. 2. Army Regulation 635-5 (Separation Documents), then in effect, established the standardized policy for preparing and distributing the DD Form 214. This regulation states for item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) to enter all awards for all periods of service. Check the Soldier's records for validity of awards. DISCUSSION: Special orders awarded the applicant the Parachutist Badge.
