Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show: a. his primary military occupational specialty (MOS) as 19D (Cavalry Scout) and b. award of the Army Achievement Medal (AAM). 2. The applicant states: a. His primary MOS was 19D at the time of his discharge. He worked with a scout platoon in the 2nd Battalion, 30th Infantry Regiment, 3rd Infantry Division. b. He was awarded the AAM for his performance during MOS 19D training. 3. The applicant provides: * DD Form 214 * certificate of training * AAM Certificate CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 19 October 1983 for a period of 2 years. He completed his training and was awarded MOS 36K (Tactical Wire Operations Specialist) on 8 March 1984. 3. His DA Form 1695 (Oath of Extension of Enlistment), dated 21 October 1985, shows he extended his enlistment for a period of 18 months to participate in the Bear Program (MOS 19D) with a class graduation date of 17 April 1986. 4. He provided: a. A certificate of training for 19D1O Basic Reconnaissance Training during the period 13 January 1986 to 17 April 1986. b. An AAM Certificate, dated 17 April 1986, for meritorious service during the period 18 March 1986 to 17 April 1986. 5. Headquarters, U.S. Army Armor Center and Fort Knox, Permanent Orders 77-10, dated 22 April 1986, awarded him the AAM for meritorious achievement for the period 18 March 1986 to 17 April 1986. 6. Headquarters, 3d Infantry Division, Orders 102-6, dated 27 May 1986, show he was reassigned to Headquarters and Headquarters Company, 2nd Battalion, 30th Infantry, in primary MOS 19D. 7. His DA Form 2-1 (Personnel Qualification Record – Part II) shows he served in duty MOS 19D from 27 May 1986 to 15 April 1987. 8. United States Army Regional Personnel Center, Schweinfurt, Orders 30-34, dated 10 February 1987, show his primary MOS as 31K (Combat Signaler). 9. On 17 May 1987, he was honorably released from active duty. 10. His DD Form 214 does not show the AAM as an authorized award. 11. Item 11 (Primary Specialty Number, Title and Years and Months in Specialty) of his DD Form 214 shows he held primary MOS 31K for 3 years and 2 months. REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, established policies and procedures for completion and distribution of the DD Form 214. The instructions for item 11 stated to enter the titles of all MOSs served for at least 1 year from the Enlisted Record Brief and include the number of years and months served for each MOS. For time determination, 16 days or more count as a month. Do not count basic training and advanced individual training. DISCUSSION: 1. Item 11 of the applicant's DD Form 214 shows he held primary MOS 31K for 3 years and 2 months. 2. His contention his primary MOS should be listed as 19D has merit. Reassignment orders show his primary MOS as 19D effective 27 May 1986 and his DA Form 2-1 shows his duty MOS as 19D from May 1986 to April 1987. He held MOS 19D for 1 year at the time of his discharge. Item 11 of his DD Form 214 erroneously shows his primary MOS as 31K. 3. Item 11 of his DD Form 214 does not show he held primary MOS 19D for 1 year and MOS 31K for 2 years and 2 months. 4. Permanent orders show he was awarded the AAM.
