THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of item 11 (Primary Specialty) of her DD Form 214 (Certificate of Release or Discharge from Active Duty). 2. The applicant states she was awarded secondary military occupational specialty (MOS) 71L (Administrative Specialist) on 26 February 1990. Omission of this information caused lower pay in her current job. 3. The applicant provides MOS orders, dated 26 February 1990. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 20 September 1983 and she remained on active duty through continuous reenlistments. 3. She provided 199th Personnel Service Company, Orders 51-204, dated 26 February 1990, awarding her secondary MOS 71L effective 26 February 1990. 4. Her Enlisted Record Brief, dated 19 September 2002, shows secondary MOS 71L. 5. On 30 September 2004, she retired in the rank of sergeant first class after completing over 20 years of active service. 6. Item 11 of her DD Form 214 shows the entry "02J4O 00 CLARINET PLAYER - - 20 YRS [Years] – 6 MOS [Months]//NOTHING FOLLOWS." REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for preparation of the DD Form 214. The instructions for item 11 stated to enter the titles of all MOSs served (clarified by the U.S. Army Human Resources Command to mean held) for at least 1 year from the Enlisted Record Brief and include the number of years and months served for each MOS. For time determination, 16 days or more count as a month. Do not count basic training and advanced individual training. DISCUSSION: 1. Item 11 of the applicant's DD Form 214 shows she held MOS 02J4O for 20 years and 6 months. 2. The evidence of record shows she was awarded secondary MOS 71L on 26 February 1990 and her Enlisted Record Brief shows this secondary MOS. She held MOS 71L for 14 years and 7 months at the time of her retirement. 3.
