Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the following awards: * Armed Forces Expeditionary Medal (AFEM) * Army Achievement Medal (AAM) * North Atlantic Treaty Organization (NATO) Medal 2. The applicant states his DD Form 214 does not reflect any awards for his service in Bosnia. His DD Form 214 is missing the AFEM for his participation in Operation Joint Guard, the NATO Medal for his service in former Yugoslavia, and the AAM. After returning from overseas, his parent unit was on a training exercise and his awards were never processed. 3. The applicant provides: * Temporary change of station order, 276-00204, dated 3 October 1997 * Memorandum for record, dated 1 April 1998 * DA Form 638 (Recommendation for Award), dated 20 April 1998 * DD Form 214 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 19 August 1994 for a period of 4 years. He was honorably discharged on 27 November 1997 for immediate reenlistment. He reenlisted on 28 November 1997 for a period of 3 years. 3. He provided: a. A memorandum for record from his commanding officer, dated 1 April 1998, requesting the NATO Medal and certificate be issued to the applicant. b. A DA Form 638, dated 20 April 1998, recommending award of the AAM for outstanding service as a rifle company medic during Operation Joint Guard in Bosnia-Herzegovina during the period 10 March 1997 to 10 May 1998. This form shows the AAM was approved and issued by Headquarters, 2nd Battalion, 22nd Infantry, in Permanent Orders 98-01 on 28 April 1998. 4. On 18 March 1999, he was honorably discharged. 5. His DD Form 214 shows he was awarded or authorized the: * Army Service Ribbon * National Defense Service Medal * Sharpshooter Marksmanship Qualification Badge with Rifle Bar (M-16) REFERENCES: 1. Military Personnel Message Number 99-100 authorized award of both the Armed Forces Service Medal and Armed Forces Expeditionary Medal as a one-time exception to Department of Defense and Service policy for qualifying service in support of Operations Joint Endeavor/Joint Guard in the Republic of Bosnia-Herzegovina. This exception allowed both service medals to be presented to personnel deployed to Bosnia-Herzegovina during the periods 1 June 1992 to 19 December 1996 (Operation Joint Endeavor) and 20 December 1996 to 20 June 1998 (Operation Joint Guard). This exception also allowed only one award of each service medal for service in either or both Operation Joint Endeavor and/or Operation Joint Guard. 2. Army Regulation 600-8-22 (Military Awards) states the NATO Medal is authorized by the Secretary-General of the NATO for specific NATO operations. The Secretary of Defense may approve acceptance and wear by U.S. service members who meet the criteria specified by the Secretary-General of NATO. DISCUSSION: 1. The applicant is authorized award of the Armed Forces Service Medal and Armed Forces Expeditionary Medal for his service in support of Operation Joint Guard in Bosnia-Herzegovina as a one-time exception to Department of Defense and Service policy. His DD Form 214 does not show these medals. 2. The memorandum for record from his commanding officer, dated 1 April 1998, requesting the NATO Medal and certificate be issued to the applicant confirms he met the eligibility criteria for this medal and is sufficient as a basis for adding the NATO Medal to his DD Form 214. 3. Permanent Orders show he was awarded the AAM.
