THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests: a. removal of the Army Achievement Medal (AAM) Certificate, dated 22 February 2012, showing his organization as the 38th Engineer Company, 2nd Battalion, 23rd Infantry Regiment, from his Official Military Personnel File (OMPF) and b. addition of the AAM Certificate, dated 22 February 2012, showing his organization as Alpha Company (formally known as Company A), 2nd Battalion, 23rd Infantry Regiment, to his OMPF. 2. The applicant states the AAM Certificate in his OMPF displays an incorrect company assignment (38th Engineer Company). The correct unit is Company A. The U.S. Army Human Resources Command will not take the certificate out of his records because it is not a duplicate. 3. The applicant provides: * AAM Certificate, dated 22 February 2012, showing his organization as the 38th Engineer Company, 2nd Battalion, 23rd Infantry Regiment * AAM Certificate, dated 22 February 2012, showing his organization as Alpha Company, 2nd Battalion, 23rd Infantry Regiment CONSIDERATION OF EVIDENCE: 1. The applicant is currently serving in the Regular Army in the rank of staff sergeant. 2. His records contain a DA Form 638 (Recommendation for Award) showing he was awarded the AAM for achievement during the period 28 November 2011 to 2 December 2011 by Headquarters, 2nd Battalion, 23rd Infantry Regiment, Permanent Order Number 053-005, dated 22 February 2012. This form shows the applicant was assigned to Alpha Company, 2nd Battalion, 23rd Infantry Regiment. 3. The AAM Certificate in question, dated 22 February 2012, shows his organization as the 38th Engineer Company, 2nd Battalion, 23rd Infantry Regiment. 4. He provided an AAM Certificate, also dated 22 February 2012, showing his organization as Alpha Company, 2nd Battalion, 23rd Infantry Regiment. 5. A review of the performance folder of his OMPF in the Interactive Personnel Electronic Records Management System (iPERMS) revealed the contested AAM Certificate. REFERENCES: Army Regulation 600-8-104 (Army Military Human Resource Records Management) prescribes Army policy for the creation, utilization, administration, maintenance, and disposition of the OMPF. Appendix B (Documents Authorized for Filing in the Army Military Human Resource Record and/or iPERMS) and the U.S. Army Human Resources Command website provide a listing of documents authorized for filing in iPERMS. These sources state to file award documents in the performance folder of the OMPF. Paragraph 3-6 provides that once a document is properly filed in the OMPF, the document will not be removed from the record unless directed by the Army Board for Correction of Military Records or other authorized agency. DISCUSSION: 1. In order to justify deletion or amendment of a report, the burden of proof rests with the applicant to produce evidence that establishes clearly and convincingly that action is warranted to correct a material error, inaccuracy, or injustice. 2. The applicant contends his correct organization was Company A, 2nd Battalion, 23rd Infantry Regiment, when he was awarded the AAM for the period 28 November 2001 to 2 December 2001 and his DA Form 638 clearly supports his contention. 3. It appears that an administrative error occurred when the AAM Certificate showing his organization as the 38th Engineer Company, 2nd Battalion, 23rd Infantry Regiment, was prepared and subsequently filed in his OMPF. 4. The evidence shows an AAM Certificate, dated 22 February 2012, correctly showing his organization as Alpha Company, 2nd Battalion, 23rd Infantry Regiment, was also prepared.
