Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction of his military records to show his home of record (HOR) as Las Vegas, NV. 2. The applicant states: a. He initially entered the U.S. Army Reserve from Louisville, KY, and that was his HOR at the time. While serving in the U.S. Army Reserve, he transferred to a unit in Illinois and his HOR remained Kentucky. He then entered active duty when he was in Illinois by enlisting in the Regular Army at the Chicago Military Entrance Processing Station (MEPS). His HOR then became Lombard, IL. b. He left the Regular Army and entered the Nevada Army National Guard in Las Vegas, NV. After his time in the Nevada Army National Guard, he again enlisted in the Regular Army while living in Las Vegas. He processed through the Salt Lake City, UT, MEPS, which is the station used for the Las Vegas, NV, area. c. The orders issued by the MEPS list his HOR as Las Vegas, NV, and he thought that would be reflected in his Enlisted Record Brief (ERB), but it is not. His DD Form 4 (Enlistment/Reenlistment Document – Armed Forces of the United States) lists his HOR as Pulaski, TN, and his place of enlistment as Las Vegas, NV. The Pulaski, TN, address is his family's address and what was on his driver's license at the time. He was told when he signed his contract that his HOR would be based on the location of the MEPS where he enlisted, but his HOR on his ERB shows Pulaski, TN. d. He is currently going through the medical evaluation board process and will be out of the Army soon. Once he's out of the Army, he will be relocating to Las Vegas, NV; therefore, he would like his HOR corrected so he has no problems once he is separated and relocates. 3. The applicant provides: * Salt Lake City, UT, MEPS Orders 4162006, dated 3 June 2014 * DD Form 4, dated 11 June 2014 CONSIDERATION OF EVIDENCE: 1. After prior periods of enlisted service in the U.S. Army Reserve from 5 February 2007 through 26 January 2010, Regular Army from 28 January 2010 through 22 August 2013, and U.S. Army National Guard from 23 August 2013 through 10 June 2014, the applicant enlisted in the Regular Army on 11 June 2014. He is currently serving on active duty at Fort Campbell, KY. 2. He provided MEPS, Salt Lake City, UT, Orders 4162006, dated 3 June 2014, which show his HOR as Las Vegas, NV. 3. The DD Form 4 he signed and executed on 11 June 2014 shows his HOR as Pulaski, TN, and his place of enlistment as Las Vegas, NV. 4. The DD Form 1966 (Record of Military Processing – Armed Forces of the United States) he signed and executed on 11 June 2014 shows his current address as Las Vegas, NV, and his HOR as Pulaski, TN. 5. None of his enlistment documents show his HOR as Las Vegas, NV. A copy of his ERB is not available for review and was not provided by the applicant, but he claims it reflects his HOR as Pulaski, TN. REFERENCES: 1. Army Regulation 601-210 (Active and Reserve Components Enlistment Program) provides policies and procedures for preparation of enlistment contracts. It states the HOR address entered on the enlistment contract will be the address declared by the individual to be his/her permanent home or actual home at the time of enlistment. The address entered on the DD Form 1966 must be in the continental United States or a U.S. territory. A temporary address will not be entered. 2. Army Regulation 601-280 (Army Retention Program), table 11-1, provides instructions for completing the DD Form 4. It states the HOR is the place recorded as the home of the individual when commissioned, appointed, enlisted, inducted, or ordered into the relevant tour of active duty. The place recorded as the HOR of the individual when reinstated, reappointed, or reenlisted remains the same as that recorded when commissioned, appointed, enlisted, or inducted or ordered into the relevant tour of active duty unless there is a break in service of more than 1 full day. Only if a break in service exceeds 1 full day can the HOR be changed by the member. 3. The Joint Travel Regulations provide that the HOR is the place recorded as the home of the individual at the time of enlistment or induction. There is no authority to change the HOR as officially recorded at the time of entry into military service. However, there is authority to correct an HOR if erroneously entered on the records at that time, and then only for travel and transportation purposes. Correction of the HOR must be based on evidence that a bona fide error was made and the HOR as corrected must have been the actual home of the individual at the time of entry into the relevant period of service. DISCUSSION: 1. Regulatory guidance dictates the HOR address is designated by the applicant upon enlistment. The DD Form 4 and DD Form 1966, both signed by the applicant at the time of his second enlistment in the Regular Army, show his HOR as Pulaski, TN. 2. He states his HOR was Lombard, IL, (not Pulaski, TN) at the time of his prior active duty enlistment. This has no bearing on the HOR for his current enlistment as his periods of Regular Army service were not continuous without a break of at least 1 day; thus his previous HOR could have been changed upon his second enlistment in the Regular Army to the HOR he designated at that time. 3. Although he claims he was informed his HOR in his Army records would reflect the HOR shown on the MEPS orders, policy and procedures in place dictate the HOR on the DD Form 4 and DD Form 1966 reflect the address declared by the applicant at the time of enlistment. Additionally, his place of residence or permanent mailing address after separation has no bearing on his HOR. Correction of the HOR must be based on evidence that a bona fide error was made.
