Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his social security number (SSN) as , a completely different number than listed on his DD Form 214. 2. The applicant states: a.  Both he and his brother had the same SSN and this affected his pay records. b.  When he tried to get the matter straightened, his SSN was incorrectly listed as his brother's SSN. 3. The applicant provides a copy of his DD Form 214. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant's complete military records are not available for review. A check of records maintained by the National Personnel Records Center shows a Navy service member with the same last name and SSN as the applicant. 3. The applicant's DD Form 214 shows: a.  he enlisted in the Regular Army on 19 September 1979; b.  his SSN as , c.   he was honorably released from active duty on 18 September 1982 for completion of required service and transferred to the U.S. Army Reserve Control Group (Reinforcement), and d.  he completed 3 years of net active service. 4. His DA Form 3540 (Certificate and Acknowledgement of Service Requirements for individuals Enlisting, Reenlisting, or Transferring into Troop Program Units of the U.S. Army Reserve), dated 29 November 1982, shows his SSN as . 5. U.S. Army Reserve Components Personnel and Administration Center Orders , dated 12 January 1983, relieved him from assignment to the U.S. Army Reserve Control Group (Reinforcement) and assigned him to the 1010th Service and Supply Company, Pittsburg, KS, effective 11 December 1982. These orders show his SSN as . 6. 89th U.S. Army Reserve Command Orders 072-012, dated 17 October 1983, relieved him from assignment to the 1010th Service and Supply Company, Pittsburg, KS, and assigned him to the U.S. Army Reserve Control Group (Annual Training). These orders show his SSN as . 7. U.S. Army Reserve Personnel Center Orders D-08-052705, dated 13 August 1985, honorably discharged him from the Ready Reserve. These orders show his SSN as . 8.
