THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 6 September 1996 to show a second award of the Army Good Conduct Medal (AGCM) for the period 7 September 1993 to 6 September 1996. 2. The applicant states: a. She requests issuance of orders for award of the AGCM (2nd Award) for the period 7 September 1993 to 6 September 1996 while she was serving in an enlisted status in the Regular Army. b. There is no error. 3. The applicant provides: * DD Forms 4 (Enlistment/Reenlistment Document – Armed Forces of the United States), dated 7 September 1990 and 5 September 1996 * DD Forms 214 for the periods ending 17 December 1988 and 6 September 1996 * AGCM orders, dated 25 October 1993 CONSIDERATION OF EVIDENCE: 1. Having prior enlisted service in the U.S. Army Reserve, the applicant enlisted in the Regular Army on 7 September 1990 for a period of 6 years. 2. Headquarters, 502d Personnel Support Battalion, Permanent Order 50-14, dated 25 October 1993, awarded her the AGCM for the period 8 September 1990 to 7 September 1993. 3. On 6 September 1996, she was honorably discharged after completing 6 years of creditable active service with no lost time. 4. Her DD Form 214 for the period ending 6 September 1996 shows she was awarded or authorized the: * Army Lapel Button * Army Achievement Medal * AGCM * National Defense Service Medal * Noncommissioned Officer Professional Development Ribbon * Army Service Ribbon * Expert Marksmanship Qualification Badge with Rifle Bar 5. There are no orders for a second award of the AGCM. There also is no evidence of any disciplinary action or a commander's disqualification that would have precluded her from being awarded a second AGCM. 6. She is currently serving in an Active Guard Reserve status in the rank of major. REFERENCES: Army Regulation 600-8-22 (Military Awards) states the AGCM is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of active Federal military service. Although there is no automatic entitlement to the AGCM, disqualification must be justified. DISCUSSION: 1. The applicant completed a qualifying period of service for the first award of the AGCM from 7 September 1990 through 6 September 1993 (3 years). However, she was awarded the AGCM for the period 8 September 1990 through 7 September 1993 (beginning and ending dates off by 1 day). 2. These orders should be amended to show the qualifying period for award of the AGCM (1st Award) as 7 September 1990 through 6 September 1993. 3. It appears she met the eligibility criteria for the second award of the AGCM for the period 7 September 1993 through 6 September 1996 based on completion of 3 years of qualifying service.
