Board Determination/Recommendation 2. Evidence and Consideration BOARD DATE: 2 May 2018 DOCKET NUMBER: AR20160012805 BOARD DETERMINATION/RECOMMENDATION: The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined the overall merits of this case are insufficient as a basis to amend the decision of the Army Board for Correction of Military Records set forth in Docket Number AR20150000856, dated 10 September 2015. ___________x______________ CHAIRPERSON I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. BOARD DATE: 2 May 2018 DOCKET NUMBER: AR20160012805 THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests reconsideration of his earlier request to correct his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his foreign service in Vietnam. 2. The applicant states he served with Company A, 502nd Supply and Transport Battalion, 2nd Armor Division, in Vietnam. He served in the Quang Tri Province during 1973 working in supply. His DD Form 214 does not reflect this foreign service. His unit records should show his service in Vietnam. His platoon leader recorded him as being absent without leave and because of this his DD Form 214 does not show his service in Vietnam. 3. The applicant provides no additional evidence. CONSIDERATION OF EVIDENCE: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20150000856 on 10 September 2015. 2. The applicant's contentions are new evidence that were not previously considered by the Board and warrant consideration at this time. 3. He enlisted in the Regular Army on 29 September 1972 for a period of 2 years. 4. Item 31(Foreign Service) of his DA Form 20 (Enlisted Qualification Record) is blank. 5. On 12 February 1974, he was honorably discharged. 6. Item 22c (Foreign and/or Sea Service) of his DD Form 214 shows no foreign service. 7. There is no evidence of record showing he served in Vietnam. 8. On 10 September 2015, the ABCMR denied his request to correct his DD Form 214 to show his foreign service in Vietnam. REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, governed preparation of the DD Form 214. This regulation provided that the total active duty service performed outside the continental limits of the United States for the period covered by the DD Form 214 and the last overseas theater in which the service was performed would be entered in item 22c. Later versions of this regulation required that the inclusive dates of service in Vietnam performed on or after 5 August 1964 would be listed the remarks block. DISCUSSION: 1. Although the applicant contends he served in Vietnam in 1973, there is no evidence to support this contention. 2. Item 31 of his DA Form 20 and item 22c of his DD Form 214 show no foreign service. 3. There is no evidence showing he served in Vietnam. //NOTHING FOLLOWS// ABCMR Record of Proceedings AR20150000953 Enclosure 1 ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS ABCMR Record of Proceedings (cont) AR20160012805 2 ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS Enclosure 1 ABCMR Record of Proceedings (cont) AR20160012805 2 ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS Enclosure 2
