Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Legion of Merit (LM) and Humanitarian Service Medal (HSM). 2. The applicant states he received both awards in the mail after his retirement and he was instructed to apply to the Army Board for Correction of Military Records for correction of his records. 3. The applicant provides: a. LM Certificate; b. DA Form 638 (Recommendation for Award) for award of the LM, dated 5 January 2015; c. DD Form 1610 (Request and Authorization for Temporary Duty Travel of Department of Defense Personnel), dated 17 November 2013; d. DD Form 1610, dated 18 November 2013; e. Joint Task Force (JTF)-505 Manning Table of Personnel, undated; and f. Joint Staff memorandum, dated 14 January 2015, subject: Approval of the HSM for Republic of the Philippines Relief Efforts – Operation Damayan. CONSIDERATION OF EVIDENCE: 1. Having prior enlisted service in the Regular Army, the applicant was appointed as a Reserve warrant officer of the Army on 2 July 1998 with concurrent order to active duty. 2. The DA Form 1610, dated 15 November 2013, shows he was authorized temporary duty travel from Fort Shafter, HI, to Manila, Philippines, for 10 days on 17 November 2013. 3. The DA Form 1610, dated 15 November 2013, shows he was authorized temporary duty travel from Fort Shafter, HI, to Manila, Philippines, for 151 days on 18 November 2013. 4. He provided a manning table for JTF-505 showing he was assigned as the Joint Logistics Coordination Element Support-06 Officer at Camp Aguinaldo, Philippines. 5. His DA Form 67-9 (Officer Evaluation Report) for the period 1 January 2013 through 31 December 2013 shows he served as the Senior Supply Systems Technician assigned to the 8th Theater Sustainment Command, Fort Shafter, HI. In Part Vb (Performance and Potential Evaluation – Comment on Specific Aspects of the Performance), his rater commented: "During his recent deployment for Operation Damayan, he provided a civil-military bridge between the Armed Forces and US AID [U.S. Agency for International Development], World Food Program and multiple NGOs [non-governmental organizations] facilitating disaster relief to the Philippines by supporting relief efforts for 16 million people and the distribution of over 6,627 Metric tons of relief subsistence." 6. The Joint Staff memorandum, dated 14 January 2015, subject: Approval of the HSM for Republic of the Philippines Relief Efforts – Operation Damayan, announced approval of award of the HSM to service members of JTF-505, Functional Component Service Commands, and U.S. Pacific Command who were physically present and provided humanitarian assistance during the period 10 November 2013 to 1 December 2013. 7. The DA Form 638, dated 5 January 2015, and accompanying certificate awarded him the LM for the period 1 February 2005 through 31 January 2015. 9. He retired on 31 January 2015. 10. Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) of his DD Form 214 does not show award of the LM or HSM. REFERENCES: Army Regulation 635-8 (Separation Processing and Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for preparation of the DD Form 214. The instructions for item 13 state to list all Federally-recognized awards and decorations for all periods of service. DISCUSSION: 1. The applicant was awarded the LM for the period 1 February 2005 through 31 January 2015. His DD Form 214 for the period ending 31 January 2015 does not show this award. 2. The HSM was awarded to service members of JTF-505, Functional Component Service Commands, and U.S. Pacific Command who were physically present and provided humanitarian assistance during the period 10 November 2013 to 1 December 2013. 3. His records show he deployed to the Philippines and served as the JTF-505 Joint Logistics Coordination Element Support-06 Officer at Camp Aguinaldo in support of Operation Damayan.
