Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests reconsideration of his earlier request to correct his DD Form 214 (Report of Separation from Active Duty) to show award of the Combat Infantryman Badge (CIB). 2. The applicant states the CIB is missing from his DD Form 214. During his service he had dual military occupational specialties (MOSs) of both communications and infantry. While serving in Vietnam he was awarded the Bronze Star Medal with "V" Device. Since he was also infantry, he should have the CIB. 3. The applicant provides a newspaper article; however, this article is not available for review. CONSIDERATION OF EVIDENCE: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20090004603 on 26 August 2009. 2. The applicant's contentions are new evidence that were not previously considered by the Board and warrant consideration at this time. 3. The applicant enlisted in the Regular Army on 1 August 1957 and remained on active duty through continuous reenlistments. 4. His DA Form 20 (Enlisted Qualification Record) shows: * he was awarded MOS 31G (Tactical Communication Chief) effective 23 July 1969 * he held duty MOS 05C (Radio Teletype Operator) while assigned to Headquarters and Headquarters Service Battery, 2nd Battalion, 33rd Artillery, 1st Infantry Division, in Vietnam from 4 September 1966 to 22 August 1967 * no CIB 5. Headquarters, 1st Infantry Division, General Orders Number 3603, dated 21 May 1967, awarded him the Bronze Star Medal with "V" Device for heroism on 10 March 1967 in Vietnam. 6. On 4 January 1974, he was honorably discharged for expiration term of service. His DD Form 214 for the period ending 4 January 1974 does not show the CIB as an authorized award. 7. There are no orders for the CIB in the available records. 8. On 26 August 2009, the ABCMR denied his request for award of the CIB. REFERENCES: Army Regulation 600-8-22 (Military Awards) states a Soldier must meet the following three requirements for award of the CIB: (1) he must be an infantryman satisfactorily performing infantry duties, (2) he must be assigned to an infantry unit during such time as the unit is engaged in active ground combat, and (3) he must actively participate in such ground combat. Campaign or battle credit alone is not sufficient for award of the CIB. DISCUSSION: 1. The applicant contends the CIB is missing from his DD Form 214. 2. The governing regulation for award of the CIB clearly establishes the criteria for award of the CIB. The Soldier must be an infantryman satisfactorily performing infantry duties; he must be assigned to an infantry unit of brigade, regimental, or smaller size during such time as the unit is engaged in active ground combat; and he must actively participate in such ground combat. 3. The evidence of record shows he served as a radio teletype operator in duty MOS 05C while assigned to Headquarters and Headquarters Service Battery, 2nd Battalion, 33rd Artillery, 1st Infantry Division, during his assignment in Vietnam. 4. There is no evidence showing he held an infantry MOS or was assigned to an infantry unit during his assignment in Vietnam. 5.
