Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to reflect: a. he completed 3 years of honorable service prior to the incident that led to his discharge and b. completion of the U.S. Army Ranger and U.S. Army Jungle Warfare Courses. 2. The applicant states: a. The honorable period of service shown on his DD Form 214 is 16 February 2010 through 10 April 2012, but he did not leave the Honor Guard until March 2013, nearly a year after his reenlistment date. He had been at the 25th Infantry Division for a year before the incident leading to his discharge occurred and he believes he should have at least 3 years of honorable service credited on his DD Form 214. b. While at the 25th Infantry Division, he was selected for assignment by the Battalion Reconnaissance Platoon and he attended the U.S. Army Ranger and U.S. Army Jungle Warfare Courses. He believes this should be included in his DD Form 214 training time. c. The period of honorable service credited on his DD Form 214 does not allow him to receive the full GI Bill educational benefits, which requires 36 months of honorable service. He is only receiving 80 percent of his GI Bill educational benefits and getting full credit would help him with his tuition. His initial enlistment contract included the Army College Fund (Kicker) and he is also not eligible for this tuition benefit because he is credited with less than 36 months of honorable service. 3. The applicant provides: * correspondence from the Office of Undergraduate Admissions, Southern Methodist University, dated 11 May 2016 * DD Form 214 CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army on 17 February 2010 for a period of 3 years and 16 weeks. 2. He reenlisted on 11 April 2012 for a period of 4 years. 3. The Military Education block of his Enlisted Record Brief does not show entries for the U.S. Army Ranger and U.S. Army Jungle Warfare schools. 4. He was discharged under honorable conditions (general) on 10 November 2014 by reason of misconduct (serious offense). 5. His DD Form 214 shows in: a. item 14 (Military Education), no entries for the U.S. Army Ranger and U.S. Army Jungle Warfare Courses; and b. item 18 (Remarks), the entries: * CONTINUOUS HONORABLE ACTIVE SERVICE: 20100216-20120410 [16 FEBRUARY 2010 THROUGH 10 APRIL 2012] * IMMEDIATE REENLISTMENTS THIS PERIOD -- 20120411-20141110 [11 APRIL 2012 THROUGH 10 NOVEMBER 2014] REFERENCES: 1. Army Regulation 635-8 (Separation Processing and Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for preparation of the DD Form 214. It states the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. a. The instructions for item 14 state to list all formal, in-service (full time attendance) training courses successfully completed during the period of service covered by the DD Form 214 of at least 1 week or 40 hours in duration. (As an exception to full-time attendance, list Command and General Staff College and Senior Service Colleges completed by correspondence courses). Include course title, length in weeks, and year completed. This information is to assist the Soldier in job placement and counseling; therefore, do not list training courses for combat skills. b. The instructions for item 18 state: (1) enter: "SOLDIER (HAS) OR (HAS NOT) COMPLETED FIRST FULL TERM OF SERVICE." If a Soldier completed or exceeded the initial enlistment, enter "HAS." However, if a Soldier reenlists before completion of that period of service, the first term of service is effectively redefined by virtue of the reenlistment contract. A prior service enlistee is considered to be on a second term of military service, even if that Soldier fails to complete the current term of service, the appropriate entry is "HAS"; (2) for enlisted Soldiers with more than one enlistment period during the time covered by this DD Form 214, enter "IMMEDIATE REENLISTMENTS THIS PERIOD" and specify the inclusive dates for each period of reenlistment; and (3) for Soldiers who previously reenlisted without being issued a DD Form 214 and are separated with any characterization of service except "HONORABLE," enter "CONTINUOUS HONORABLE ACTIVE SERVICE FROM (first day of service for which DD Form 214 was not issued) UNTIL (date before commencement of current enlistment)." Then, enter the specific periods of reenlistment as prescribed above. DISCUSSION: 1. The applicant contends his period of honorable service is not properly annotated on his DD Form 214 and should include at least 3 years of honorable service. 2. The evidence of record shows he enlisted in the Regular Army on 16 February 2010. He was honorably discharged on 10 April 2012 for the purpose of immediate reenlistment. He reenlisted 11 April 2012. He was discharged on 10 November 2014 under honorable conditions (general). 3. Army Regulation 635-8 provides guidance for entering periods of Regular Army service in item 18 of the DD Form 214. It states that if a Soldier reenlists before completion of that period of service, the first term of service is effectively redefined by virtue of the reenlistment contract. 4. Item 18 of his DD Form 214 properly listed his first period of Regular Army service as continuous honorable active service from 16 February 2010 through 10 April 2012 (the date before commencement of the current enlistment). Item 18 of his DD Form 214 also properly annotates his next period of Regular Army service as 11 April 2012 until his discharge on 10 November 2014. 5. The applicant contends his U.S. Army Ranger and U.S. Army Jungle Warfare Courses were not annotated on his DD Form 214. 6. Army Regulation 635-8 provides guidance for entering military education in item 14 of the DD Form 214. It states to enter all formal, in-service (full time attendance) training courses successfully completed for job skills courses to assist the Soldier in job placement and counseling. Training courses for combat skills are not listed. 7. There is no evidence indicating he completed either of these courses.
