THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests reconsideration of his earlier request to correct his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his dates of service in Vietnam. 2. The applicant states he was on temporary duty in Vietnam from 22-28 June 1967. 3. The applicant provides a DA Form 2139 (Military Pay Voucher). CONSIDERATION OF EVIDENCE: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20140004621 on 23 October 2014. 2. The DA Form 2139 provided by the applicant is new evidence that was not previously considered by the Board and warrants consideration at this time. 3. The applicant was inducted into the Army of the United States on 15 September 1965. 4. He provided a Military Pay Voucher showing: * he arrived in Vietnam on 22 June 1967 * he departed Vietnam on 28 June 1967 * he was attached to the 509th Radio Research Group 5. He participated in one campaign during this period. 6. Item 31 (Foreign Service) of his DA Form 20 (Enlisted Qualification Record) shows he served in U.S. Army Pacific, Hawaii, from 4 March 1966 through 9 September 1967. 7. On 9 September 1967, he was honorably released from active duty. 8. His DD Form 214 shows he was awarded or authorized the: * National Defense Service Medal * Expert Marksmanship Qualification Badge with Rifle Bar (M-14) * Army Good Conduct Medal 9. His DD Form 214 shows in: * item 22c (Foreign and/or Sea Service) – he served in the U.S. Army Pacific for 1 year, 6 months, and 6 days * item 30 (Remarks) – no Vietnam service 10. On 23 October 2014, the ABCMR denied his request to show foreign service in Vietnam. REFERENCES: 1. Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. a. The Vietnam Service Medal is awarded to all members of the Armed Forces of the United States for qualifying service in Vietnam after 3 July 1965 through 28 March 1973. Qualifying service included attachment to or assignment for 1 or more days with an organization participating in or directly supporting military operations. b. A bronze service star is worn on the Vietnam Service Medal for each credited campaign. 2. Army Regulation 635-5 (Separation Documents), in effect at the time, governed preparation of the DD Form 214. The regulation provided that the total active duty service performed outside the continental limits of the United States for the period covered by the DD Form 214 and the last overseas theater in which the service was performed would be entered in item 22c. Later versions of this regulation required that the inclusive dates of service in Vietnam performed on or after 5 August 1964 would be listed the remarks block. 3. Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) lists the awards received by units serving in Vietnam. This pamphlet shows Headquarters and Headquarters Company, 509th Radio and Research Group was awarded the Meritorious Unit Commendation for actions during the period 1 June 1966 to 30 September 1967 in Department of the Army General Orders Number 48, dated 1968. 4. Department of the Army General Orders Number 8, dated 1974, announced award of the Republic of Vietnam Gallantry Cross with Palm Unit Citation to Headquarters, U.S. Military Assistance Command, and its subordinate units during the period 8 February 1962 to 28 March 1973 and to Headquarters, U.S. Army Vietnam, and its subordinate units during the period 20 July 1965 to 28 March 1973. DISCUSSION: 1. The DA Form 2139 provided by the applicant confirms his Vietnam service from 22-28 June 1967. Item 30 of his DD Form 214 does not show this service. 2. As a related issue, based on his service in Vietnam and participation in one campaign, he is authorized award of the Vietnam Service Medal with one bronze service star. His DD Form 214 does not show this medal. 3. Also, his unit in Vietnam was awarded the Meritorious Unit Commendation during his period of assignment. His DD Form 214 does not show this unit award. 4. The Republic of Vietnam Gallantry Cross with Palm Unit Citation was awarded to all units that served in Vietnam. The applicant served in Vietnam during a qualifying period.
