The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in effect, on 12 September 2008 until 17 December 2008, he was in training with the 192nd Infantry Brigade, Foxtrot 2nd Battalion, 54th Infantry Regiment, at Fort Benning, GA. Upon completion with his first enlisted contract, he re-classed into military occupational specialty (MOS) 92A10. He also completed Quartermaster School from 15 November 2011 to 3 February 2012, and would like to have the following MOS’ added and/or corrected to his DD Form 214: a. Item 11 (Primary Specialty) should reflect: * 11B10, Infantry, 3 years and 4 months * 92A10 Automated Logistical Specialists, 2 years and 6 months b. Item 14 (Military Education) should indicate: * Infantryman, 13 weeks, 2008 * Automated Logistical Specialist, 11 weeks, 2012 3. On 21 August 2008, the applicant enlisted in the Regular Army (RA), in the Career Management Field (CMF) 11X (Infantry Recruit). 4. His Enlisted Record Brief, Section IX (Assignment Information), shows he completed basic training and Individual One Station Unit Training at the Infantry Training Brigade, 54th Infantry, 2nd Battalion, Company F, from 12 September 2008 to 29 December 2008. 5. The applicant provides his Certificate of Training, which shows he successfully completed an Individual One Station Unit Training Infantry Training Course for the period 12 September 2008 to 17 December 2008. 6. On 10 November 2010, the applicant requested and was approved to reenlist in the RA for a period of four years, under the Army Training Reenlistment Option for MOS 92. 7. A DA Form 1059 (Service School Academic Evaluation Report), dated 3 February 2012, shows he attended, completed, and achieved course standards for the Automated Logistical Specialist Course for the period 15 November 2011 through 3 February 2012. This document shows his MOS as 92A. 8. The applicant provides a diploma from the U.S. Army Quartermaster School, for the successful completion of the Automated Logistical Specialist Course, dated 3 February 2012 for the period 15 November 2011 – 3 February 2012. 9. On 9 November 2014, he was honorably released from active duty upon the completion of his required active duty service. His DD Form 214 shows the following information: a. Item 11 – “92A10 AUTOMATED LOGISTICAL – 5 YRS 10 MOS”. b. Item 14 – “AUTOMATED LOGISTICAL SPECIALIST, 12 WEEKS, 2008//COMBAT LIFE SAVERS CRS, 1 WEEK, 2012//COMBATIVES LEVEL 1, 1 WEEK, 2008”. 10. Army Regulation 635-8, states to list on the DD Form 214 all MOS, in which the applicant served in for at least 1 year, with the number of years and months served. Time spent in basic training and advanced individual training are not counted. In addition, to list all of his formal, in-service (full time attendance) training courses successfully completed during the period of service, consisting of at least 1 week or 40 hours duration will be added BOARD DISCUSSION: After review of the application and all evidence, the Board determined that there is sufficient evidence to grant full relief. The record indicates that item 11 of the applicant’s DD Form 214 is incorrect and does not reflect the applicant’s service in the 11B MOS or attendance at Infantry School. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-8 (Separations Documents), dated 10 February 2014, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Active Army. It provided that the DD Form 214 was a synopsis of the Soldier's most recent period of continuous active duty. The DD Form 214 provided a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. a. Block 11: Primary Specialty. Enter the titles of all MOSs or areas of concentration (AOCs) awarded and held for at least 1 year during the current period of service and include for each MOS/AOC the number of years and months held. For time determinations, 16 or more days counts as a month. Do not count time in training (basic training, advanced individual training, Basic Officer’s Leader Course, or MOS-producing school). Primary specialty MOS or AOC is awarded by Service school completion or by publication of orders awarding the MOS or AOC. b. Block 14: Military Education.
