The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his DD Form 214 does not reflect the requested service or medal. 3. The applicant provides: a. Certificate, dated 2 August 1993, awarding him the Army Achievement Medal for achievement while deployed to Mogadishu, Somalia, in support of Operation Continue Hope, from 26 May 1993 to 9 September 1993 (3 months and 14 days) by permanent Orders Number 32-25. b. Certificate of Achievement, dated 10 August 1993, recognizing his efforts while deployed to Somalia for participation in Operation Continue Hope. 4. Review of the applicant's service records shows: a. Having had prior service, he enlisted in the Regular Army on 31 March 1993. b. He was honorably released from active duty on 31 March 1995. He completed 3 years of active service. His DD Form 214 shows in: * item 12f (Foreign Service), the entry "0000-00-00" * item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized), National Defense Service Medal, Army Lapel Button, Army Service Ribbon, Expert Marksmanship Qualification Badge with Grenade Bar, Sharpshooter Marksmanship Qualification Badge with Rifle Bar, and Driver and Mechanic Badge with Driver - W Bar * item 18 (Remarks) does not list any service in Somalia c. After his separation from active duty, Headquarters, 4th Infantry Division, Fort Carson, CO published Permanent Orders 97-1600 in 7 April 1995, awarding him the Army Good Conduct Medal (1st Award) for service from 14 October 1992 through on or about 6 April 1994. 5. By regulation (Army Regulation (AR) 635-5 (Separation Documents)), the DD Form 214 provides a Soldier with documentary evidence of their military service. * Item 12f shows the total amount of foreign service completed during the period covered by the DD Form 214 and is obtained from the Soldier’s records * Item 13 shows all awards and decorations * Item 18, for an active duty Soldier deployed with his or her unit during their continuous period of active service, enter the statement "Service in (Name of County Deployed) from (inclusive dates for example, YYYYMMDD – YYYMMDD)" 6. AR 600-8-22 (Military Awards) does not list an awards called "Somalia Campaign Medal.' However, by regulation (AR 600-8-22), the Armed Forces Expeditionary Medal is awarded for participation in Operation Restore Hope and Operation United Shield in Somalia from 5 December 1992 through 31 March 1995. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined that relief was warranted. The Board found that the documentary evidence presented by the applicant and found within the military service record of the applicant support granting relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 ending on 31 March 1995 as follows: * item 12f (Foreign Service), delete "0000-00-00" and add "0000-03-14" * item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized), add the Armed Forces Expeditionary Medal * item 18 (Remarks), add the entry "Service in Somalia 19930526 to 19930909" Additionally, prior to closing the case, the Board noted the administrative notes reflected below by the analyst of record and recommended those changes be made to the applicant’s DD214 to more accurately depict his military service. I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. ADMINISTRATIVE NOTE(S): The applicant’s record confirms he is authorized awards that are not recorded on his DD Form 214 for the period ending 31 March 1995. His DD Form 214 will be administratively corrected to show: * Army Achievement Medal * Army Good Conduct Medal (1st Award) REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents) establishes the standardized policy for processing the DD Form 214. The purpose of the separation document is to provide the individual with documentary evidence of their military service. It states: * Item 12f (Foreign Service) shows the total amount of foreign service completed during the period covered by the DD Form 214 and is obtained from the Soldier’s records * Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) shows awards and decorations * Item 18 (Remarks), for an active duty Soldier deployed with his or her unit during their continuous period of active service, enter the statement "Service in (Name of County Deployed) from (inclusive dates for example, YYYYMMDD – YYYMMDD)" 3. Army Regulation 600-8-22 (Military Awards) states the Armed Forces Expeditionary Medal is awarded for qualifying service after 1 July 1958 in U.S. military operations, U.S. operations in direct support of the United Nations, and U.S. operations of assistance for friendly foreign nations. Qualifying service for this award includes participation in Operation Restore Hope and Operation United Shield in Somalia from 5 December 1992 through 31 March 1995.2.
