Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests removal of Headquarters, 8th Legal Support Organization, Memorandum for Record, dated 14 September 2007, subject: Award of the Overseas Service Ribbon from her Official Military Personnel File (OMPF). 2. The applicant states the memorandum needs to be removed from her OMPF. Her commander signed the document awarding the Overseas Service Ribbon, but the award should have been the Army Reserve Component Overseas Training Ribbon. The period of service from 14 August to 1 September 2007 does not warrant time to receive tour credit. 3. The applicant provides: * Memorandum for Record, dated 14 September 2007 * email from the U.S. Army Human Resources Command CONSIDERATION OF EVIDENCE: 1. The applicant is currently serving in the U.S. Army Reserve in the rank of major. 2. Headquarters, 8th Legal Support Organization, Memorandum for Record, dated 14 September 2007, subject: Award of the Overseas Service Ribbon, shows she is authorized to receive the Overseas Service Ribbon for duty during the period 14 August to 1 September 2007. 3. There is no evidence in the available records showing she completed an overseas tour during the period 14 August to 1 September 2007. 4. A review of the performance folder in her OMPF in the interactive Personnel Electronic Records Management System revealed a copy of the memorandum for record in question. REFERENCES: 1. Army Regulation 600-8-22 (Military Awards) states the Overseas Service Ribbon was established by the Secretary of the Army on 10 April 1981. Effective 1 August 1981, all members of the Active Army, Army National Guard, and Army Reserve in an active Reserve status are eligible for the award for successful completion of overseas tours. 2. Table D-1 (Overseas Tour Lengths) of Army Regulation 614-30 (Overseas Service) states the standard overseas tour lengths based on Congressional guidance is 36 months/accompanied or 24 months/unaccompanied. 3. Army Regulation 600-8-104 (Army Military Human Resource Records Management) prescribes Army policy for the creation, utilization, administration, maintenance, and disposition of the Army Military Human Resource Record. Paragraph 3-6 provides that once a document is properly filed in the OMPF, the document will not be removed from the record unless directed by the ABCMR or other authorized agency. DISCUSSION: 1. The applicant requests removal of the Headquarters, 8th Legal Support Organization, Memorandum for Record, dated 14 September 2007, subject: Award of the Overseas Service Ribbon from her OMPF because her commander issued the wrong award, the award should have been the Army Reserve Components Overseas Training Ribbon, and the period of service does not warrant time to receive tour credit for award of the Overseas Service Ribbon. 2. The governing regulation states the standard overseas tour lengths is 36 months/accompanied or 24 months/unaccompanied. 3.
