The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in effect, the entries in items 12f and 12h were accidently reversed. 3. On 12 February 2008, the applicant enlisted in the Regular Army for a period of 3 years. 4. On 16 February 2011, the applicant was released from active duty. Her DD Form 214 contains the following information: a. item 12f, shows the entry, "0000 04 05," b. item 12h, shows "0000 05 02," and c. item 18 (Remarks), shows the entry " SERVED IN A DESIGNATED IMMINENT DANGER PAY AREA//SERVICE IN AFGHANISTAN 20090219-20090623" (a period of 4 months and 5 days). 5. The applicant provides an Enlisted Records Brief, dated 14 February 2011, which shows: a. Section I – Assignment Information (Overseas (OS)/Deployment Combat Duty) contains the following entries and codes: (1) Start-End Date - "20090219-20090623" (4 months and 5 days) (2) CT (Country) - "AF" (Afghanistan) (3) MO (Months) - "5" (4) TS (Tour Completion Status) – "2" ("2" represents normal tour not complete) (5) TT (Tour Type) "C" ('C" represents combat) b. Section IX – Assignment Information shows the applicant entered active duty on 12 February 2008 and she completed advanced individual training on or about 13 July 2008; a period of 5 months and 2 days. 6. Army Regulation 635-8 (Separation Processing and Documents) provides the regulatory guidance for completing the various blocks included on the DD Form 214. This regulation states: a. for block 12f (Foreign Service) enter the total amount of service performed outside the continental United States (OCONUS) during the period covered in block 12c (Net Active Service this Perios). In addition, list periods of deployed service in block 18 (Remarks). b. for block 12h (Initial Entry Training) enter the total amount of service time required to complete basic training, advanced individual training, or one station unit training, if that training occurred during the period of service covered on block 12c. BOARD DISCUSSION: After review of the application and all evidence, the Board determined there is insufficient evidence to grant relief. The applicant’s contentions were carefully considered. Based upon the preponderance of evidence, the Board agreed the DD Form 214 is correct with the calculated dates of initial entry training and service in Afghanistan. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), then in effect, established the standardized policy for preparing and distributing the DD Form 214. a. Foreign service, taken from the ERB, performed during the period covered in item 12c (Net Active Service This Period) of the individual's DD Form 214 would be entered in item 12f. b. When an active duty Soldier was deployed with his or her unit during the period covered by the DD Form 214, the entry "SERVICE IN (name of country) FROM (inclusive dates in YYYY/MM/DD format)" would be entered in item 18. 3. Army Regulation 635-8 (Separation Processing and Documents), currently in effect, prescribes the transition processing function of the military personnel system, including preparation of the DD Form 214. The DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. It states: a. for block 12f (Foreign Service) enter the total amount of service performed outside the continental United States (OCONUS) during the period covered in block 12c (Net Active Service this Perios).
