The applicant requests the Expert Field Medical Badge (EFMB) be added to his DD Form 214 (Certificate of Release or Discharge from Active Duty), for the period ending 27 August 1982. 2. The applicant states his DD Form 214 does not list the Expert Field Medical Badge he received on 13 February 1981 at Fort Hood, TX. THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. The applicant provides a self-authored statement, dated 25 May 2016. 2. Evidence from the applicant’s service record and Department of the Army and Department of Defense records and systems: * DD Form 214 for the period ending 27 August 1982 * DA Form 2-1 (Personnel Qualification Record (PQR)), dated 8 November 1979 REFERENCES: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents) establishes the policy for preparing and distributing the DD Form 214. The regulation directs that the purpose of the separation document is to provide the individual with documentary evidence of his or her military service at the time of release from active duty, retirement, or discharge. 3. Army Regulation 600-8-22 (Military Awards) states that commanders, lieutenant colonel and above, who have the resources and facilities are authorized to conduct the required tests, as prescribed by the U.S. Army Medical Department Center and School (AMEDDC&S) for the EFMB. Enlisted personnel must have an Army Medical Department (AMEDD) primary military occupational specialty (MOS) or an MOS of 18D (Special Forces). Eligible personnel must be on active duty or assigned to a troop program unit in the Reserve component or an AMEDD mobilization augmentation agency. Award of the EFMB is announced in orders. DISCUSSION: 1. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, and has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Army on 28 August 1979. 3. The applicant’s military record does not contain a certificate of training or orders announcing award of the EFMB. There is no entry for the EFMB on his DA Form 2-1 in item 9 (Awards, Decorations, and Campaigns). The applicant was released from active duty on 27 August 1982. 4. There is no evidence in the available records showing he met all of the testing requirements for the EFMB.
