The applicant did not file within the 3 year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he just now realized information was missing from his DD Form 214, and he recently learned how to correct his record. 3. On 7 March 1989 the applicant enlisted in the Regular Army. 4. The applicant provided a copy of his United States Army Infantry School diploma showing he graduated from the basic Airborne Course on 8 June 1990. 5. On 28 July 1992 the applicant was honorably released from the Regular Army. He was issued a DD Form 214 that does not show the Parachutist Badge or completion of the Airborne Course. 6. Headquarters, U.S. Maneuver Center of Excellence, Fort Benning, Georgia confirmed the applicant successfully completed the parachutist's course as a member of Airborne Class Number 30-90 from 21 May to 8 June 1990, and he was awarded the Parachutist Badge in accordance with paragraph 8-11, Army Regulation 600-8-22 (Military Awards). 7. A search of his electronic personnel record failed to reveal orders announcing award of the Parachutist Badge. BOARD DISCUSSION: The Board considered the applicant’s request with all supporting documents, evidence in the service record and applicable policies and guidance. The preponderance of evidence shows the applicant had an Airborne Course Diploma and Headquarters, U.S. Maneuver Center of Excellence, Fort Benning, Georgia confirmed the applicant successfully completed the parachutist's course as a member of Airborne Class Number 30-90 from 21 May to 8 June 1990, and he was awarded the Parachutist Badge in accordance with paragraph 8-11, Army Regulation 600-8-22 (Military Awards). The Board finds corrections to the applicant’s records are warranted. As a result, the Board recommends that all Department of Army records of the individual concerned be corrected by amending his DD Form 214 by awarding him the Airborne Course and the Parachutist Badge. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), then in effect, established the standardized policy for preparing and distributing the DD Form 214. This regulation stated for item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) to enter all awards for all periods of service. Check the Soldier's records for validity of awards. For item 14 (Military Education) list in-service training courses by title, number of weeks and year successfully completed during the period of service covered by the DD Form 214; e.g. medical, dental, electronics, supply, administrative, personnel or heavy equipment operations. This information is to assist the Soldier after separation in job placement and counseling; therefore, training courses for combat skills will not be listed. 3. Army Regulation 600-8-22 (Military Awards) states award of the basic parachutist Badge requires that an individual must have satisfactorily completed the prescribed proficiency tests while assigned or attached to an airborne unit or the Airborne Department of the Infantry School or have participated in at least one combat parachute jump.
