The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined the overall merits of this case are insufficient as a basis to amend the decision of the Army Board for Correction of Military Records, pertaining to the Combat Infantryman Badge, set forth in Docket Number AR20110022885, dated 15 May 2012. 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests reconsideration of his earlier request for award of the Combat Infantryman Badge (CIB). As a new issue, he requests an unspecified award for meritorious service with bronze star. 2. The applicant states he was separated for hardship and these awards were not recorded on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge). He should have received a CIB for his service in Vietnam and an award for meritorious service with bronze star. 3. The applicant provides: * DA Form 137 (Installation Clearance Record) * page 2 of AR20110022885 CONSIDERATION OF EVIDENCE: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20110022885 on 15 May 2012. 2. The applicant's contentions and supporting documentation are new evidence that were not previously considered by the Board and warrant consideration at this time. 3. The applicant enlisted in the Regular Army on 16 September 1968 for a period of 3 years. He completed his training and was awarded military occupational specialty (MOS) 11D (Armor Reconnaissance Specialist). He departed the continental United States en route to Vietnam on 30 September 1969. 4. His DA Form 20 (Enlisted Qualification Record) shows: * he held MOS 11D while assigned to Troop E, 17th Cavalry, 173rd Airborne Brigade, from 3 October 1969 to 2 January 1970 * he held MOS 11D while assigned to Company C, 1st Battalion (Airborne), 503rd Infantry, from 3 January to 31 March 1970 * no award of the CIB 5. He departed Vietnam en route to the continental United States on or about 1 April 1970. 6. On 1 April 1970, he was honorably released from active duty. 7. His DD Form 214 (Armed Forces of the Unites States Report of Transfer or Discharge) shows he was awarded or authorized the: * National Defense Service Medal * Sharpshooter Marksmanship Qualification Badge with Rifle Bar (M-16) * one Overseas Service Bar * Parachute Badge * Vietnam Service Medal 8. There are no orders for award of the CIB in the available records. 9. The applicant did not provide nor do his records contain evidence to show he actively participated such ground combat. 10. There is no evidence showing he was awarded any personal decoration for meritorious service. 11. On 11 December 2009, a DD Form 215 (Correction to DD Form 214) amended his DD Form 214 by deleting the Vietnam Service Medal and adding the following awards to his DD Form 214: * Army Good Conduct Medal * Vietnam Service Medal with two bronze service stars * Republic of Vietnam Campaign Medal with 1960 Device * Republic of Vietnam Gallantry Cross Unit Citation with Palm Device * Republic of Vietnam Civil Actions Honor Medal Unit Citation, First Class 12. On 15 May 2012, the ABCMR denied his request for award of the CIB. REFERENCES: Army Regulation 600-8-22 (Military Awards) states a Soldier must meet the following three requirements for award of the CIB: (1) he must be an infantryman satisfactorily performing infantry duties, (2) he must be assigned to an infantry unit during such time as the unit is engaged in active ground combat, and (3) he must actively participate in such ground combat. Campaign or battle credit alone is not sufficient for award of the CIB. DISCUSSION: 1. The applicant contends his DD Form 214 is missing the CIB for his services in Vietnam. 2. The governing regulation for award of the CIB clearly establishes the criteria for award of the CIB. The Soldier must be an infantryman satisfactorily performing infantry duties; he must be assigned to an infantry unit of brigade, regimental, or smaller size during such time as the unit is engaged in active ground combat; and he must actively participate in such ground combat. 3. Although he held duty MOS 11D and was assigned to an infantry unit in Vietnam, there is no evidence showing he was assigned to this unit during such time as the unit was engaged in active ground combat and that he actively participated in such ground combat. 4. Although he contends he should have received an award for meritorious service with bronze star, there is no evidence showing he was awarded any personal decoration for meritorious service.
