THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests reconsideration of his earlier request to correct his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his date of birth (DOB) as XX XXXX XXXX instead of XX XXXX XXXX. 2. The applicant states his DOB should be changed to reflect what is on his birth certificate. When he was drafted into the Army he used his baptism certificate to show his DOB. This certificate shows XX XXXXX 19XX, which is different (by two days) from his birth certificate. This DOB discrepancy will create problems for him when he applies for Medicare. The social security office has his correct DOB. 3. The applicant provides: * baptismal certificate * birth certificate CONSIDERATION OF EVIDENCE: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20130005336 on 31 October 2013. 2. The applicant's contentions are new evidence that were not previously considered by the Board and warrant consideration at this time. 3. He provided a copy of his baptismal certificate, dated 12 August 1963, showing his DOB as XX XXXXX XXXX. 4. He was inducted into the Army of the United States on 28 June 1972. His DD Form 47 (Record of Induction) shows his DOB as XX XXXX XXXX. 5. On 30 June 1996, he retired in the rank of sergeant major. 6. Item 5 (DOB) of his DD Form 214 shows his DOB as XX XXXX XXXX. 7. His service personnel records shows his DOB as XX XXXX XXXX. 8. He provided a copy of his birth certificate, issued on 9 January 2013, showing his DOB as XX XXXX XXXX. 9. On 31 October 2013, the ABCMR denied his request to change his DOB on his DD Form 214. REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for preparation of the DD Form 214. The instructions for item 5 stated to enter the six-digit number; year, month, and day without spaces or slashes (e.g., 690312 for 12 March 1969). DISCUSSION: 1. The applicant contends the DOB shown on his DD Form 214 is incorrect. 2. Although the birth certificate he provided shows his DOB as XX XXXX XXXX, the evidence of record shows he reported his DOB as XX XXXXt XXXX at the time of his induction in 1972 and he served in and was retired using the DOB of XX XXXX XXXX. 3. For historical purposes, the Army has an interest in maintaining the integrity of its records. The data and information contained in those records should reflect the conditions and circumstances that existed at the time the records were created. In the absence of a showing of material error or injustice, there is a reluctance to recommend that those records be changed. 4. The applicant is advised that a copy of this decisional document will be filed in his military records.
