Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, the Army Reserve Components Achievement Medal. 2. The applicant states he served for 3 years in the Army Reserve and Army National Guard. 3. The applicant provides National Guard Bureau (NGB) Form 22 (Report of Separation and Record of Service). CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. With prior service in the U.S. Navy (USN), the applicant enlisted in the Washington Army National Guard (WAARNG) on 9 April 1983. 3. On 15 July 1983 the applicant’s request for discharge from the WAARNG and enlistment in the U.S. Army Reserve (USAR) was approved by a representative of the WAARNG. 4. On 5 September 1983 the applicant was honorably discharged from the WAARNG. He received an NGB Form 22 showing he served for 4 months and 26 days in an ARNG troop program unit. 5. On 6 September 1983 he enlisted in the USAR for 3 years in pay grade E-3. His DD Form 4/1 (Enlistment/Reenlistment – Armed Forces of the United States) shows in item 9 (Previous Military Service upon Enlistment/Reenlistment) that he had 3 years, 11 months and 10 days of total active military service (USN) and 2 years, 5 months and 18 days of total inactive military service. 6. On 22 March 1985 he was reassigned from a USAR troop program unit to the USAR Control Group (Reinforcement). Orders 35-09 issued by Headquarters, 124th USAR Command on 15 March 1985 show the reason for his reassignment was unsatisfactory participant. 7. On 5 September 1986 he was honorably discharged from the USAR Ready Reserve. REFERENCES: Army Regulation 600-8-22 (Military Awards) states the Army Reserve Components Achievement Medal is authorized for award to Army personnel, including Active Guard Reserve officers, in the rank of colonel and below for exemplary behavior, efficiency, and fidelity while serving as a member of an Army National Guard or Army Reserve troop program unit or as an individual mobilization augmentee. Individuals must have completed 4 years of qualifying service on or after 3 March 1972 and before 28 March 1995. Beginning on 28 March 1995, the period of qualifying service for award of the Army Reserve Components Achievement Medal was reduced from 4 to 3 years. This change is not retroactive. Such years of qualifying service must have been consecutive. A period of more than 24 hours between Reserve enlistments or an officer’s service will be considered a break in service. Credit toward earning the award must begin anew after a break in service. ? DISCUSSION: It appears the applicant did not have 4 years of qualifying service in the ARNG or the USAR for the Army Reserve Components Achievement Medal. The additional criteria for this award requires exemplary behavior, efficiency, and fidelity. Within months of enlisting in the WAARNG, he was discharged and enlisted in the USAR for 3 years.
