Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his service in the Republic of Honduras, Central America, while assigned to the 40th Supply and Service Company deployed out of Fort Carson, CO, 4th Infantry Division (Mechanized) from 1 September 1983 to 8 February 1984. 2. The applicant states: a. The political atmosphere immediately following the Vietnam Conflict resulted in Congressional enactment of the war powers resolution of 1973 in an attempt to restrict the president's ability to deploy combat equipment, America troops into hostile and imminently dangerous foreign nations such as Honduras. b. Countless low-intensity conflicts erupted throughout Honduras and neighboring borders regions involving armed American troops and all were kept entirely secret or after mistakenly discovered by the press or members of Congress, or factually altered by executive branch agencies to appear to fall under the protective umbrella of a military "training mission" status. c. He desires the correction in the event the war in the Republic of Honduras is ever classified as an official combat operation and he deserves any and all benefits he earned during his deployment there. 3. The applicant provide a copy of Headquarters, Fort Carson and Headquarters, 4th Infantry Division (Mechanized) Orders Number 8-265, dated 15 August 1983. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the U.S. Army Reserve Delayed Enlistment Program on 24 January 1973. 3. On 30 January 1973, he was honorably discharged from the U.S. Army Reserve for immediate enlistment in the Regular Army. 4. On 31 January 1973, he enlisted in the Regular Army. 5. He provided a copy of Headquarter, Fort Carson and Headquarters, 4th Infantry Division (Mechanized) Orders Number 8-265, dated 15 August 1983, that directed his temporary duty to the Republic of Honduras for participation in Exercise AHUAS TARA II (Big Pine) for a period of 179 days with a proceed on or about date listed as 30 August 1983. 6. Item 5 (Oversea Service) of his DA Form 2-1 (Personnel Qualification Record – Part II) shows his participation in Exercise AHUAS TARA II during the period 31 August 1983 through 26 February 1984. 7. On 31 January 1995, he was retired. His DD Form 214 does not show his service in Honduras during the period 31 August 1983 through 26 February 1984. REFERENCES: Army Regulation 635-5 (Separation Documents) prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, or release from active duty service or control of the Active Army. It establishes standardized policy for preparing and distributing the DD Form 214. Instructions state for item 81 (Remarks) for an active duty Soldier deployed with his or her unit during their continuous period of active service, enter "SERVICE IN (name of country deployed) FROM (inclusive dates for example, YYYYMMDD- YYYYMMDD)."
